Substance over form, but also form over substance? In a well-reasoned opinion, Judge Kathryn Davis ruled that COFC has jurisdiction over a bid protest challenging a follow-on production contract awarded under the Army's Other Transactions (OT) authority, but *then* dismissed for lack of standing because of a 4-month lapse in the protester's SAM registration. There are two clear takeaways from the opinion: (1) If a follow-on production contract seeks to acquire supplies or services for the Government, then COFC has jurisdiction to hear a post-award protest, "whether the agency issued the follow-on solicitation under OT authority or under FAR authority." In a 'I am glad someone finally said it' moment, this is a logical extension of the existing jurisdictional authority involving OTs. (2) If a solicitation incorporates FAR 52.204-7, then all offerors *must* ensure their SAM registration is current while proposals are pending. But the FAR doesn't apply to OTs, you say? That's right, but the Army incorporated FAR 52.204-7 in the solicitation anyway. And while the risk to the Government is virtually non-existent when a lapse is cured before award (as it was here), COFC has been clear: the Court will apply the plain meaning of FAR 52.204-7, whether a solicitation is issued under OT authority or FAR authority.
