In a recent case, a party raised a special plea challenging a founding and confirmatory affidavits on the basis that the affidavits were commissioned virtually and therefore not “in the presence of” the Commissioner of Oaths. The commissioning was conducted via video conference and the dependents were situated in Italy whilst the Commissioner of Oaths was based in South Africa.
The Court held that the Commissioner was an attorney, duly admitted to the High Court of South Africa and consequently a Commissioner of Oaths appointed in terms of the provisions of section 8(1)(b) of the Justices of the Peace and Commissioners of Oaths Act 16 of 1963. Accordingly, the Court found that there was substantial compliance with the statutory legislation. The court encouraged that there should be compliance with legislation but also to technology that may result in future.

Small law firms and Scaling:
In my limited time in practice, I have seen small law firms fail due to an inability to scale their businesses in order to suit their market reality. Scale is dictated, largely, by two factors:
1. Client base.
2. Geographical location.
The two are, more often than not, inter-related. Law firms who are situated in the macro-cities of South Africa like Johannesburg and Cape Town, tend to attract more corporate clients and thus grow significantly quicker than their more geographically disadvantaged counterparts. So in practice, firms that have existed for the exact same amount of time do not necessarily grow at the same rate.
To put this in focus: just because Practice X has existed for a shorter period than Practice Y, and it has now employed two new associate attorneys, does not mean that Practice Y should do the same. Practice Y may offer a “boutique” feel which caters perfectly for its own client base, while Practice X’s larger staff complement may be more appealing to its corporate clients. They are just two distinct practices that are catering for their unique market realities.
Moral of this story? Stay in your lane. 😉
