As a Solicitor for England & Wales, I am extremely proud and honoured as a member of the Westminster & Holborn Law Society (comprises around 10,000 admitted solicitors and legal professionals) to be featured in the latest edition of its highly respected magazine “CENTRAL LONDON LAWYER ". See pages 12-13. The main message I would like to send out is that nobody should try to box you in or clip your wings. Believe in yourself. Aim high, and flourish. Look for your point of difference (it’s what helps you stand apart). If you're in an environment that doesn't celebrate your difference, then you're in the wrong environment! There should be no limits except the ones you establish for yourself. ⚡️ In an interesting turn of events, the Bar Council of India's decision to allow foreign law firms to set up shop in India, enable foreign lawyers to register in India and practise non-litigious matters vide the notification of the 'Rules for Registration and Regulation of Foreign Lawyers and Foreign Law Firms in India, 2022' have been challenged in the Delhi High Court by a group of lawyers (Narendra Sharma and Ors. v. Bar Council of India and Ors. - W.P.(C) 1556/2024). ☀️ This will reignite the discusisons on the entry of foreign law firms in India and its consequences. With arguments in favour and against such a move, the legal fraternity in India seems to be divided in its approach to this particular issue. With one side arguing that entry of foreign law firms in India wil increase competiton, provide better access to Indian law firms and lawyers alike and the other side arguing that such entry of foreign law firms could kill competition and cause severe implications on talent retention. This is perhaps a topic for detailed discussion for a later point in time. For now all eyes are on Delhi High Court to see what comes out of this petition! #STPerspective #BCI #foreignlawfirm

s.24. Power of court to remove arbitrator - The English Commercial Court removed a sole #arbitrator under s.24 of the Arbitration Act 1996 (the Act). In H1 & another -v- W & others [2024] EWHC 382 (Comm), the Court found that there could be no reasonable objection to the fact that the sole arbitrator knew a number of the factual witnesses/all three of the #expertwitnesses on one side. It is useful to note that within a specialist sector this is expected - However, the Court agreed that there was an appearance of bias, placed on the arbitrator’s comments about the parties expert witnesses generally, and specifically the comments made towards the assured’s experts, which suggested that the arbitrator did not have an open mind on one of the core issues in dispute. In the Romanian edition, you can find an interesting article wrote by our colleague, Marius Grigorescu, on the arbitral award and the request for annulment under Romanian law. The article explains that the domestic courts regard the award as dual in nature, contractual and jurisdictional, while the request for annulment is only one and addresses all the issues arising during the arbitral proceedings. The focus of the article is on a new case-law setting forth that the term for filing the request for annulment runs only after the arbitral tribunal has ceased its mandate. The European Commission has highlighted that the recently approved European Arrest Warrant (Amendment) Act 2024 still fails to align Irish law with EU requirements. Despite the legislation's intent to address issues raised in 2020, the Commission has identified new concerns. Key points of contention include the incorrect transposition of provisions related to decisions rendered in absentia, the determination of the competent judicial authority, and the handling of pending decisions and competing international obligations.
