"Overvetting seems to be part and parcel of how the SSA operates, leading inevitably to backlogs. The ad-hoc committee on the General Intelligence Laws Amendment Bill heard from the SSA that all successful applicants for positions in the public service could, potentially, be vetted. The vetting process has lost focus. Far from contributing to the fight against crime, this loss of focus is hampering it. A related problem is that the national intelligence structures, including the SSA, have a very long history of overclassifying information. Today, the President issued a groundbreaking Executive Order to address the #nationalsecurity risks posed by commercial transactions that enable #China, #Russia, and other countries of concern to lawfully acquire and access Americans’ sensitive personal data. Described by the White House as “the most significant executive action any President has ever taken to protect Americans’ data security,” the E.O. fills critical gaps in existing authorities. For years, the U.S. Government has warned that adversaries increasingly view Americans’ sensitive personal data as a strategic resource and are trying to acquire it. That data can be used to engage in malicious cyber-enabled activities, espionage, and blackmail, to build profiles on and target individuals and groups for surveillance and influence, and for other nefarious purposes. Big-data analytics, #AI, and other technological developments exacerbate these risks, making it easier, cheaper, and more effective to manipulate and use this data. Even as the U.S. Department of Justice works to prosecute and address hacking and other illicit means of obtaining this data, it remains legal to acquire this data through commercial relationships. Geolocation data, genomic data, health and financial data, and other #sensitivedata is for sale on the open market. Countries of concern also have legal and political systems to compel or coerce companies and individuals subject to their jurisdiction to give them access to sensitive data as part of vendor, #investment, employment, and other commercial relationships with U.S. persons. Why engage in complicated hacking when you can compel a company to provide access? Why compel access when the data can be bought? While existing authorities like the Committee on Foreign Investment in the United States and Team Telecom allow these #datasecurity risks to be addressed on a case-specific basis for discrete kinds of activities, no existing laws comprehensively and prospectively address these risks. This E.O. starts the process of changing that. The E.O.’s cornerstone directs the Department of Justice to implement a targeted new national-security regulatory program to prohibit and restrict classes of data transactions that pose unacceptable national-security risks of enabling countries of concern to access bulk sensitive personal data or certain data on U.S. Government personnel and locations, whether directly or through companies and individuals subject to their jurisdiction, control, ownership, or direction. DOJ’s National Security Division has published an Advance Notice of Proposed Rulemaking laying out more than 90 pages of details on the contemplated program and seeking public comment. Want more?
