Big news today as we learn that yesterday, January 31, EPA Administrator Regan signed a proposed rule to list nine PFAS as RCRA "hazardous constituents". We've seen this coming, but many thought it would only include PFOS and PFOA. Administrator Regan also signed a proposed rule titled "Definition of Hazardous Waste Applicable to Corrective Action for Releases from Solid Waste Management Units" which clarifies that all RCRA "hazardous constituents" will be subject to RCRA Corrective Action. I'll be sharing more on the implications of this in the near future, so stay tuned.
