This Deicorp site, nestled in Rosebery, is undergoing a change in use as it is redeveloped from a commercial and industrial site into a multi-storey mixed-use retail and residential building, overlying basement car parking. EI’s involvement at the site traces back to 2014, when the first phase of the environmental and geotechnical investigation works were completed. This article is related to a specific regulatory process in California, USA, involving the Department of Water Resources (DWR) and the Delta Stewardship Council. The fundamentals of governance that come into play here include: 1. Regulatory compliance: DWR is complying with the Delta Reform Act and the Delta Stewardship Council's regulatory process by posting a draft certification of consistency for the proposed geotechnical activities. 2. Judicial oversight: The Sacramento Superior Court's ruling on June 20, 2024, directed DWR to submit a certification of consistency for the proposed geotechnical activities, which DWR is now doing. 3. Transparency: DWR is providing public notice by posting the draft certification of consistency at least 10 days prior to formal submission. 4. 𝗗𝘂𝗱𝗹𝗲𝘆𝘃𝗶𝗹𝗹𝗲 𝗗𝗮𝗺 𝗥𝗲𝗺𝗼𝘃𝗮𝗹 𝗶𝗻 𝗦𝗵𝘂𝘁𝗲𝘀𝗯𝘂𝗿𝘆, 𝗠𝗔. Dam condition, hazard classification, and creativity on the part of project partners teed up this removal in a fraction of the typical timeline…and it was removed in less than 2 weeks. Of the estimated 3,000 dams in Massachusetts, some do retain relevant functions and others are more complicated candidates for removal, but hundreds (thousands?) like this one can and should (from ecological, resilience, and risk reduction perspectives) be removed in less than 6 months from start of permitting through construction, at total costs under $100,000. Environmental regulations treat these structures as ecological detriments (have you seen many new dams built lately?). Our hope is that projects like this will encourage regulatory authorities to start with removal as the preferred alternative for relic dams, and work with proponents on creative pathways to accelerate project delivery. Prop 218 (and later, Prop 26) fundamentally changed how #publicagencies raise revenue & recover costs. This session, 3 bills have been introduced to once again amend this process. Although these bills were drafted w/ the intention of providing additional clarity to public agencies, they will also undoubtedly add additional reqs. & constraints to an already confusing process. Hudbay may need more permit reviews for Copper World -Tony Davis Jul 6, 2024 Developers of the Copper World complex, where six open pits are planned south of Tucson, may soon get the state groundwater protection permit they need, but that won’t end conflict over the permit. Two features of Hudbay Minerals’ Inc.’s proposed plan for protecting groundwater at its mine in the Santa Rita Mountains will need to go through a separate round of permitting, possibly with additional public comments and meetings, regardless of how the current round turns out. That’s because these features were included in Hudbay’s 2023 preliminary feasibility study for Copper World, but not in the 2022 application Hudbay submitted to the Arizona Department of Environmental Quality for an Aquifer Protection Permit. Such a permit is needed for the mine to be built and to operate. That’s the word from ADEQ in response to questions from the Arizona Daily Star. The department’s action won’t go as far as mine opponents want. Led by the longtime opposition group Save the Scenic Santa Ritas, they want the entire permit rejected and a new permit required to covr those and two other changes they say are significant. Simply put, the opponents’ view is, as they wrote in comments to ADEQ, “The mine proposed in the (permit) application is a placeholder only and is not the mine Hudbay intends to build.” “The application process should be suspended until an accurate mine description, with accompanying technical analysis, is included in the application,” the group said. “There are significant changes to the mine as proposed in the application.” A requirement for additional permitting for the mine will at least delay the end of the entire aquifer protection permitting process, and force Hudbay to undergo additional reviews before it can be sure of having the final state approval of the project.
