The impact of violence on clients and their cases, particularly domestic violence and its various forms, including coercive control, is challenging to identify. To address this, the Attorney-General's Department introduced seven National Principles to Address Coercive Control in Family and Domestic Violence. Lawyers should review the National Principles, and clients can access a simplified version. Coercive control can be challenging to identify due to various factors, so lawyers should establish rapport with clients, ask appropriate questions, and demonstrate empathy. The Attorney-General's Department provides fact sheets and videos in multiple languages to help recognise situations of coercive control. Resources like these empower lawyers and advisors to assist clients in identifying whether they are being subjected to coercive control or behaving in a way that could be regarded as coercive control.
We believe it is important all lawyers understand coercive control as it can impact their clients, and their cases, in many areas of law like Wills and Property, not just Family Law. Frighteningly all forms of domestic abuse are on the rise in Australia and to address the pervasiveness of coercive control the Attorney-General’s Department (‘A-G’) recently released the National Principles to Address Coercive Control in Family and Domestic Violence.
