Kigen v Thales [2022] is an important UK FRAND decision: 1. Determining that there is right for implementers to bring free-standing global FRAND rate determinations in the UK Courts; and 2. Setting a precedent for a FRAND trial to come before technical trials. The case settled this month, meaning that we no longer expect to see an appeal of the Nov 2022 decision that gave rise to the two principles above. It remains to be seen if the principles reach the Court of Appeal via another route.
