📢 The Luxembourg legislator has introduced amendments to the Luxembourg law of 5 August 2005 on financial collateral arrangements, as amended (the “2005 Law”) in the implementing statute of the Directive (EU) 2021/2167 of the European Parliament and of the Council of 24 November 2021 on credit servicers and credit purchasers. 💡 These new provisions clarify that the immunity of financial collateral arrangements and netting arrangements from the effects of insolvency proceedings or similar proceedings under the 2005 Law covers both European and non-European proceedings. 👍 The amendment eliminates any potential uncertainty in this respect in the 2005 Law and reaffirms the intent to offer a comprehensive protection against all insolvency, reorganisation measures, winding-up proceedings or similar proceedings: national, European and non-European ones.
