And with that, what exactly does a Buyer Agent do for a buyer that a Listing agent can not, does not, and will not do? ✅ Connect you to a reputable mortgage loan officer, who will educate and pre-qualify you (this important first step ensures that the seller of the right home will take your offer seriously) ✅ Search for on & off market homes - Buyers simply do not have access to ALL homes available for sale. ✅ Research neighborhoods and provide detailed information like school scores, crime rates, local amenities, noise level in the neighborhood, whether the area is walking distance to stores, restaurants, and so much more ✅ Analyze market data to determine what $$$ homes are selling for (and how fast) in neighborhoods you’re interested in, and why. If you help first time homebuyers, here are three tips for negotiation. 1. The Power of Empathy - Understand the emotions and perspectives of your counterpart to build trust. This approach helps uncover hidden motivations and can lead to more successful negotiations. 2. Accusation Audits - Acknowledge any negative perceptions the other party might have about you or your intentions upfront. By bringing these concerns to light early, you can neutralize their impact and build a stronger foundation for negotiation 3. Fathom Realty introduces new agent commission plans https://ift.tt/WFel0hH Fathom Holdings Inc., parent company of North Carolina-based Fathom Realty, announced Wednesday that it has started two new commission plans for agents. The two agent payment plans, Fathom Max and Fathom Share, complement the real estate firm’s existing plan known as Fathom One. The new plans are “designed to enhance agent recruitment and retention while promoting accelerated and sustainable growth and long-term profitability for the company,” according to its announcement. Fathom Max includes a reduced transaction fee of $465 with a cap of $9,000 per year. The company aims to increase its gross profit potential by no longer offering the Fathom One plan to new agents. Meanwhile, Fathom Share features a 12% commission split with a cap of $12,000 per year. This represents twice the revenue-sharing opportunity compared to the Fathom Max plan and is “highly competitive with other revenue share models,” the company stated. Existing agents can opt to stick with their current plan. “By offering agents flexibility and lucrative growth opportunities, we aim to attract top talent and drive sustained growth,” Fathom Holdings CEO Marco Fregenal said in a statement. “These new plans reaffirm our commitment to providing superior value to our agents and offering our agents a choice of plans while fostering organizational profitability.” Fathom Holdings is a national real estate services platform that has residential brokerage, mortgage, title and software-as-a-service offerings. Its other brands include Encompass Lending, intelliAgent, LiveBy, Real Results and Verus Title. The company has made two changes to its executive leadership team in the past year as Fregenal was named CEO in November 2023 and Jon Gwin joined as chief operating officer in May 2024. Opinion: Broker-to-broker referral exemption does not apply to agent-matching platforms https://ift.tt/m4kCdiT RESPA Section 8 and CFPB Regulation X maintain firm prohibitions against kickbacks and unearned fees, with particular statutory exemptions, about all settlement services involving federally related mortgage loans. “No person shall give, and no person shall accept any fee, kickback, or thing of value pursuant to any agreement or understanding, oral or otherwise, that business incident to or a part of a real estate settlement service involving a federally related mortgage loan shall be referred to any person.” 12 U.S.C. 2607(a). Unambiguously, 12 U.S.C. 2607(c)(3) and 12 C.F.R. 1024.14(g)(1)(v) exemptions allow payments pursuant to cooperative brokerage and referral arrangements between real estate agents and real estate brokers. This limited exemption on kickbacks only applies to fee divisions within real estate brokerage arrangements when all parties act in a real estate brokerage capacity. A bona fide brokerage sometimes needs to refer a customer to a competitor, just as a mechanic may refer a customer to another mechanic or an attorney may refer a client to another attorney. Referrals, splits, and cooperative fee arrangements between bona fide real estate brokers often help facilitate a home purchase transaction more efficiently for both the home seller and the homebuyer. However, real estate brokers may only discuss or negotiate the referral fee compensation concerning an individual transaction at hand and not as a means of consumer allocation agreements between competing brokerages. It is a per se violation of the Sherman Antitrust Act for competing real estate brokers to agree on a “standard” fee via a “blanket” referral agreement that will be paid for producing a client. It is also illegal to utilize price-fixing schemes where the purchaser of services splits the unearned fee as a means to entice consumers into using the scheme, or schemes that falsely advertise themselves to appeal to consumers as “free,” or schemes that fix real estate commissions as part of the referral. The so-called “no upfront costs” referral fee, “agent-matching services,” or “referral platforms” are not genuine brokerages acting in a brokerage capacity. For instance, in my civil lawsuit with HomeLight, the United States District Court for the Northern District of California had recently reasoned that HomeLight acts in a vertical servicer-customer relationship on a different level of the supply chain with +/-28,000 partner agents. The federal court had reasoned that HomeLight is an “upstream” supplier of paid referrals to “downstream” real estate brokers, as opposed to a real estate broker acting on the same level of distribution, where “… [E]ven though HomeLight is a licensed brokerage, in the context of this [referral] agreement HomeLight and agents are not acting as horizontal competitors …” where “… real estate agents [are]...
