My latest in the Taiwan Banker: just what is meant by #digitaltrade? If you guessed that the US tells its trading partners that it will never regulate its tech sector...you may be right, but it turns out that this answer is not acceptable domestically. With the unsuccessful #IPEF trade negotiations last year, due in part to a sudden change in its position on digital trade, it became obvious that the US lacks an alliance management plan in Southeast Asia. Although clearly many Democrats remain skeptical of anything being called "trade," in fact the issues on the digital side are more specific than for manufacturing. The US urgently a positive-sum vision for relations with countries who mostly hope to avoid #geopolitics. I suggest that #cybersecurity could form a practical basis for a new philosophy of trade, and diplomacy more broadly. Deep advantages in the software industry can help the US define the value proposition of its partnerships. Moreover, the ongoing 21st-Century Trade Initiative negotiations may provide an indication of the new US position.

Negotiations on the trade pillar of IPEF failed late last year as the US rethought its position on digital trade. IPEF will likely be delayed until after the US election, but the US-Taiwan Initiative on 21st-Century Trade contains a digital trade section, which will probably be unveiled before November. The US will need to come up with a new concept of digital trade before then. Perhaps this will be an opportunity for it to deepen its cybersecurity diplomacy? From Deputy Secretary Don Graves' remarks: "[T]he Department of Commerce will be announcing a Department-wide National Security Strategy this year in the coming weeks, which will address our major priorities and drive us forward in our mission to protect, promote, and preserve our national security." I'll say this: national security and economic security are crashing together in ways we’ve never seen before. Export controls, technology security, sanctions, global supply chain vulnerability, import restrictions, among others, are all on the table. New Proposed Exemptions to Ease China’s Cross-Border Data Transfer Compliance Rules The Cyberspace Administration of China released Draft Provisions on the Regulation and Promotion of Cross-Border Data Transfer on 28 September. The Draft Provisions seek to ease compliance requirements for cross-border data transfers. According to the proposals, a data processor may be exempt from fulfilling certain obligations, such as undergoing a security assessment, filing the signed Standard Contract, or obtaining the required certification. These exemptions have been proposed to facilitate the transfer of data outside mainland China, as mandated by Article 38 of the PRC Personal Information Protection Law. 🇨🇳💻 The Cyberspace Administration of China solicited public opinions on the draft regulations regarding the regulation and promotion of cross-border data flows. The draft proposes that those who provide personal information of more than 1 million people abroad should apply for the data exit security assessment. In addition, data related to international trade, academic cooperation, transnational manufacturing, and marketing activities that do not contain personal information or important data will no longer need to go through security assessment or certification procedures to promote domestic business activities.
