Myself and other Marks & Clerk colleagues have given the #eu #aiact quite a bit of coverage over the last few months. Today #patentattorney Annabel Williams from our #manchester office gives a great summary of its key provisions with two interesting new angles - how it might impact the #medtech sector and how its approach to risk categorisation compares with that in the equivalent legislation in #colorado, the first #us state to come out with comprehensive measures for #ai. I recently praised Colorado's lawmakers for their brevity but will their approach be a blueprint for other US State and Federal #regulations to come? #machinelearning #digitaltransformation

The #EU’s #AIAct is entering into force on 2 August 2024 and is the first of its kind to come into effect globally 🌎💥 I’ve written an article looking at how the Act categorises AI systems, what is prohibited under the Act and what is deemed ‘high risk’. While the Act is relevant to many industries, I’ve specifically considered some of the implications for #Medtech and touched on how the Act compares with #Colorado’s equivalent which is due to come into force next year.

The AI Act, initially overlooking multifunctional AI like foundation models, led to debates. Industry sought exemption, civil groups pushed for inclusion, foreseeing safety gaps and burdens on users. "General Purpose AI systems" (GPAIS) emerged in discussions, aiming to extend Act requirements to adaptable models, addressing operator responsibility. Current debate focuses on adapting the Act to cover these advanced AI, revealing its initial limitations. The paper will delve into this evolution, highlighting challenges and proposing policy adjustments for GPAIS regulation within the AI Act's framework.

The EU's Artificial Intelligence (AI) Act is set to become the first legislation globally to address the ethical and responsible use of AI. This landmark legislation introduces a risk-based classification system for AI applications, mandates transparency requirements, and outlines stringent enforcement mechanisms. The Act specifically highlights the Medtech sector, emphasising the need for stringent oversight due to the high stakes involved in healthcare applications.
