The American Alliance for Equal Rights (AAER) has recently sued the Atlanta-based Fearless Fund – led by Black women and committed to providing grants, tools, and mentorship to women of color – claiming that it's program for Black female entrepreneurs is racially discriminatory. We believe that philanthropic organizations, charitable nonprofits, and individual donors should have the right to exercise their values and views through giving money and other resources, as protected by the First Amendment. That includes efforts to support historically marginalized groups! As you know, we’re committed to addressing the inequities in the ecosystem, and providing historically excluded people with grants and tools is highly vital in creating a shift. It’s necessary to use our voices, unite and speak up to ensure this shift toward equity is possible. This is why we’ve signed a petition in resistance to this lawsuit, and in favor of continuing the philanthropic work that prioritizes historically excluded individuals. We believe that addressing inequity requires prioritizing those who have been excluded, and lawsuits like this one only create more challenges to this mission. This petition is a call on the courts to dismiss this lawsuit and uphold the First Amendment rights of philanthropic organizations, charitable nonprofits, and individual donors to give in ways that align with their values.
