On December 3, a federal court ruled that small businesses are not obligated to file beneficial ownership information reports. Prior to the ruling, small businesses that met certain criteria would have had to file reports with the Department of the Treasury by January 1, 2025, or risk fines and criminal penalties. The preliminary relief will remain in effect until the conclusion of legal proceedings, at which point the court may enter a permanent injunction. This effort to make harassing government officials a crime will soon be coming to your city and town. There are instances where government officials are being harassed and that should be addressed. There are existing harassment laws on the books that can be used to address this. Elected officials who don't like responding to emails, telephone calls or even pesky reporter questions may seek to abuse such a criminal law. A Syracuse School Board recently sent a cease and desist letter to a tv news station because they did not like a reporter seeking to question them. We have seen government officials abuse their authority by improperly denying public comments and removing people from meetings because they did not like being questioned or criticized. Isn't it interesting that there are no penalties for government officials that ignore or improperly deny FOIL requests. Nor are there penalties for violating the Open Meetings Law. https://lnkd.in/gBuK-Tak
