Article 371A of the Constitution of India has been a major hurdle in the Nagaland government's efforts to regulate small-scale illegal coal mining activities in the state. The unique land rights conferred under Article 371A have made regulating illegal coal mining activities more challenging. Residents in coal-bearing areas depend on illegal mining for sustenance and need to be educated on the adverse effects of such activities. Nagaland's coal mining policy allows rat-hole mining, but despite proper forest and environment clearances and definite mining plans, people are still operating such mines illegally. #AsiaRisk #Regulation #India Follow us for daily updates on risk and operations in Asia! https://lnkd.in/gxXvxFag

Panthera Resources PLC (AIM:PAT) has noted that the Government of Rajasthan (GoR) has announced the preferred bidder with the 'Highest Final Price Offer' of 65.3% for a mining lease on the Bhukiya-Jagpura block. This follows the issuance of a notice by the GoR on 6 March 2024 inviting bids in the auction of a mining lease of the Bhukiya-Jagpura block, substantively covering the Bhukia project. Panthera is in dispute with the Indian and Rajasthan governments over the Bhukia project due to alleged breaches of an investment treaty with Australia. Panthera also noted that the Geological Survey of India (GSI) has reported a mineral resource of 7.15 Moz of gold for Bhukia with a calculated inground value of US$16.7 billion based on the closing gold price of US$2,329/ounce on 24 June 2024. For the inescapable mining projects in India, where tribal/indigenous communities are asked to give up their ancestral lands, isn't it possible to make them as "Economic partner" or shareholder e.g. 1/3rd of project valuation? Why is it not being done? Isn't that a normal stakeholder representation required on such projects? Why dislocate them and pay them chips for taking away the asset they have. Just a thought. And the same corporate structure also presents and gets accepted a landscape and life restoration plan at end of life of such mining project. Isn't it a better way to go about the respect and honoring the rights of folks whose asset we acquire for extractive economic development. #indigenouspeoples #indigenousrights #tribalcommunities Emil Sirén Gualinga Ashish Kothari rahul banerjee Shrishtee Bajpai Ashish Puntambekar ( can be a port also) Pankaj Sekhsaria

𝐅𝐄𝐀𝐓𝐔𝐑𝐄: LUANSHYA, also described as the ‘gated town in a security wall parameter’, on April 11th this year, experienced rebirth. The town was a hive of activities, as President Hakainde Hichilema graced the US$500 million de-watering of the Luanshya Copper Mines (LCM) Shaft 28, now renamed as New Luanshya Mine. Before this development, the old mining town had earned a name as a ghost town owing to slowed down economic activities which resulted in the exodus of residents to work in other towns. These residents and others from other towns may now be attracted back to Luanshya as mining activities are gaining momentum to commence at full scale in due course with the commencement of the first critical step to de-water Shaft 28 before copper mining operations go on full scale. Put differently, ASM is about seeking dignified opportunities, illegal is mining at the barrel of a gun 🏹 ASM is environmentally destructive No. Recognizing that artisanal mining has environmental impacts, ASM has a much smaller footprint then large scale mines. Formalization further reduces ASM’s footprint 🏹 ASM derails large scale mining No. ASM is often an early indicator for large scale exploration, on the ground first and sharing land concessions later. Relationships can be positive when LSM’s engage respectfully 🏹 all artisanal mining has awful social impacts No. In some cases there are very sad realities that include things like child labor, mercury poisoning and sexual violence, but the sector is huge and diverse, with other artisanal miners having dignified opportunities. #StatecraftInTheNews: On 15 January, Khanij Bidesh India Limited (KABIL) and CAMYEN, the state-owned company of Argentina, inked a $24 million deal for a lithium mining and exploration project. The Union Ministry of Mines said that in accordance with the deal, KABIL will begin exploring and developing five lithium brine blocks in Argentina's Catamarca province. In the province, a branch office will also be established. This is the first initiative of its kind for an Indian government company. With more than half of the world's lithium resources, Argentina, Chile, and Bolivia form the "Lithium Triangle." Argentina boasts the second-largest lithium resources, third-largest lithium reserves, and fourth-largest output worldwide. This move will ensure a robust and diverse supply chain for vital and strategic minerals required for several industries in India. #India #Lithium #Argentina #KABIL #CAMYEN #Catamarca
