In the United States of America, everyone deserves access to quality health care, including reproductive health care. Fertility treatments like IVF have helped millions of people start the families they desperately want. Everyone should be free to decide when and how to start their family, without intervention from the government and politicians. In June 2022, the overturning of Roe v. Wade raised concerns about the impact on marginalized communities' access to reproductive healthcare. Sadly, last week, these concerns became a reality for patients in Alabama who depend on treatments like IVF. The Alabama Supreme Court's ruling that frozen embryos are children has caused many clinics in the state to suspend their IVF procedures. This is devastating news for the thousands of people who are relying on this care to build their families. As predicted, this decision is leading to fewer maternal health providers in Alabama and even more inaccessible care. We need to protect not only those who seek infertility care but all those who seek reproductive healthcare. As it stands today, Alabama already has one of the highest maternal mortality rates in the country. At Alife, we are committed to democratizing fertility care and encourage support for advocacy groups like American Society for Reproductive Medicine - ASRM, RESOLVE: The National Infertility Association and Doctors For Fertility, who provide updates and ways to take action.

The Alabama Supreme Court ruling on 2/16 granting fetal personhood to cryopreserved embryos and Republican Senator Cindy Hyde-Smith’s blockage of a bill to protect nationwide access to assisted reproductive technology (ART) on 2/28 will likely have far greater implications than ever imagined. Ten individuals in a span of twelve days have made decisions that may adversely affect several hundred thousand medical patients who require fertility treatment as part of their healthcare. The CDC’s National Assisted Reproductive Technology Surveillance System (NASS) allows fertility clinics to report verified data regarding any ART cycles performed in a given year. ART includes all fertility treatments that involve the handling of either eggs or embryos. Per the 2021 Data Brief, ~238,000 patients had ~414,000 ART cycles performed that year in 453 reporting fertility clinics across the nation. Approximately 2.3% of infants born in the U.S. each year are the result of ART. At this moment, several hundred thousand individuals may be experiencing significant distress, anxiety, fear, and grief due to the uncertainty or disruption of their fertility treatment and ultimately, their ability to build a family. The implications of these two significant stressors for women undergoing fertility treatment may negatively affect their current mental health, their maternal mental health during pregnancy, and their post-partum mental health. Moreover, research indicates that pre-natal mental health problems may negatively affect fetal health and development, and post-partum mental health may negatively affect the baby’s health and growth. Ten people, 12 days, potential significant mental health impact, and possible intergenerational effects. We, as a nation, need to be better.
