London School of Economics: Who delivers their courses...?

This post relates to a recent and onging personal experience when dealing with the London School of Economics, and others.

There is an expectation that when one signs up for course, be that at a university or professional service provider, that they would be the ones delivering that course.

Should that course be delivered by others, that information should be conveyed to the customer/student in clear, explicit and readily understandable content.

My recent expereince with the London School of Economics and others, has been less than transparent, to the extent that as a consumer, I believe that I have been misled into believing that I was to receive a course from, delivered by and ratified by the London School of Economics.

Having worked in tertiary education for a number of years, I recognise and understand that some universities will ratify the courses of other universities, and, also allow professional service providers to use their brand and umbrella of an educational establishment to promote courses. Whilst in itself is nothing new or incorrect, that information needs to clearly conveyed to any potential student such that it is readily identified and understood.

In the following emails you will note that I have requested a refund several times, all within a 14-day period on my original payment in full of circa £2500.

Why does this matter?

Under UK legislation in the form of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 require traders to give you certain information.

The Regulations came into force on 13 June 2014 and apply to contracts entered into on or after that date.

This applies to all contracts made over the phone or online.

Key information which the seller/trader must provide includes:

  1. a description of the goods, service or digital content, including how long any commitment will last on the part of the consumer 
  2. the total price of the goods, service or digital service or the manner in which the price will be calculated if this can’t be determined
  3. how you will pay for the goods or services and when they will be provided to you
  4. all additional delivery charges and other costs (and if these charges can't be calculated in advance, the fact that they may be payable)
  5. details of who pays for the cost of returning items if you have a right to cancel and change your mind
  6. details of any right to cancel - the trader also needs to provide, or make available, a standard cancellation form to make cancelling easy (although you aren’t under any obligation to use it)
  7. information about the seller, including their geographical address and contact details and the address and identity of any other trader for whom the trader is acting
  8. information on the compatibility of digital content with hardware and other software that the trader is aware of (or can reasonably be expected to be aware of).

Under UK Legislation, I have made several requests to cancel my attendance of the course being offered; done so within the 14-day "Cooling-Off" period; and have the expectation of a Full Refund.

However, as the payment was not actually made to the London School of Economics, but others, based in the United States and South Africa, does my purchase have UK Legal Jurisdiction?

The following emails include the latest response from the professional service provider, which essentially directs me to:

  1. Recognise that the professional service provider is registered within the State of Maryland, United States, and subject to that jurisdication's legislation.
  2. Complete and agree to an extensive cancellation policy and documentation.
  3. The professional service provider's "...Finance Team will reach out to you to discuss the financial implications associated with the cancellation."

Paraphrasing Item 3 above, this would appear to mean that the professional service provider has no intention of offering me a FULL REFUND.

My belief is that there will be some sort of "Admnistration Fee" to be able to "process" my cancellation request.

As a consumer, my belief and experience of this process is that I have been misled at best, deceived at worst.

Further, the potential for not receiving a FULL REFUND remains high, and I hold the London School of Economics liable and culpable for any financial loss which I may suffer.

Given these circumstances, what action(s) would the Linked-In community undertake to resolve this situation, and obtain a full refund?

Despite the contents of the associated Terms & Consditions, Usage and Privacy Statements, I find the manner in which LSE have presented this course, both through this page, and through targeted advertising on social media and professional communciation platform to be misleading, and potentially contrary to ASA/CAP advertising standards.
