Resolving ESG-related Disputes

Resolving ESG-related Disputes

In the October-December Issue of Corporate Disputes Magazine (the Dispute Resolution e-magazine published by Financier Worldwide Magazine ) Peter Bailey invited Heather Gagen and Doug Bryden of Travers Smith to share their insight on this topic.

The article addresses the evolving landscape of corporate transparency and responsibility on environmental, social, and governance (#ESG) matters, examining the extent to which governments, regulators, investors, and stakeholders are shifting their focus in this direction. It explores how these shifting expectations are leading to increased demands for corporate accountability and liability.

Furthermore, the article discusses the emerging ESG-related disputes that have gained prominence and provide insights into recent ESG-related cases as well as explores the lessons and implications drawn from the outcomes of these cases.

We also examine the dispute resolution mechanisms that have become popular for handling ESG-related disputes, with a comparison between litigation and arbitration among other methods.
