The Road Accident Fund (RAF) in South Africa is failing its mandate to provide timely compensation to road accident victims. The legal community needs to collaborate and hold the RAF accountable to ensure that accident victims receive the timely justice they deserve. Auxcon is calling on lawyers and claimants to unite and use data-driven strategies to address these challenges and restore the RAF to its intended purpose. **Key Issues** 👉 Excessive delays: Claims languish for 5-7 years, sometimes longer, due to administrative bottlenecks and a lack of legally trained personnel. 👉 Financial mismanagement: Despite cost-cutting efforts, the RAF faces a massive deficit and escalating liabilities, with funds not reaching victims. 👉 Misplaced blame: The RAF CEO blames lawyers for delays and financial woes, deflecting responsibility from internal issues. 👉 Disregard for court orders: The RAF routinely fails to honour court orders, further delaying payments and undermining victims' rights. 👉 Human cost: Victims and their families suffer financial ruin and emotional distress due to delayed compensation, hindering their recovery.  **Possible Solutions** ✅ Prioritising straightforward claims like loss of support and funeral expenses. ✅ Establishing a specialised RAF tribunal or settlement hub to expedite claims resolution. ✅ Hiring more legally trained personnel to improve efficiency and reduce liability. ✅ Amending the RAF Act to streamline processes and adapt to modern needs. ✅ Refocusing on the RAF's core mandate and adhering to legal obligations. According to the Road Traffic Management Corporation, vehicle defects and mechanical failures are responsible for 15% of accidents in South Africa.  Here are some tips for preventing becoming a victim of road accidents caused by vehicle defects and mechanical failures: ❗️ Keep your vehicle well-maintained: Regular vehicle maintenance is essential to prevent accidents caused by mechanical failures. Check your tyres, brakes, and steering regularly, and address any issues promptly. ❗️ Pay attention to warning signs: Warning signs such as strange noises, warning lights, or a decrease in performance can all indicate that your vehicle has a mechanical issue. If you notice any of these signs, have your vehicle inspected by a qualified mechanic as soon as possible. ❗️ Avoid overloading your vehicle: Overloading your vehicle can put extra strain on its components, increasing the risk of mechanical failures. Make sure to check your vehicle’s load capacity and avoid overloading it. ❗️ Follow safe driving practices: Safe driving practices such as avoiding sudden stops, reducing speed when driving over bumps, and maintaining a safe following distance can all help to reduce the risk of accidents caused by mechanical failures. ❗️ Use quality parts and products: Using high-quality parts and products, such as brakes and tyres, can help to reduce the risk of mechanical failures.
