The 2025 edition of #ICCMENA has officially taken off 🚀 70 law practitioners from 15 countries gathered today, 10 February, in Abu Dhabi for an ICC Institute of World Business Law Advanced Training. During four sessions, the trainers and participants tackled the topic “Oral Advocacy in International Arbitration: the good, the bad and the in-between”. 🔍 Session 1️⃣ on ‘Oral versus written advocacy: counsel and tribunal perspectives’ explored the strengths and weaknesses of both approaches, considering how elements like pleadings, witnesses, experts, and demonstratives are used in each, as well as the interplay between these choices and factors such as tribunal selection, applicable law, and the desired tribunal role. Session 2️⃣ on ‘Oral advocacy, party autonomy and the determination of the facts of the dispute: the opening statement at the hearing," addressed several key aspects of oral advocacy. These included best practices for hearings and opening statements, the use of prior written memorials, the connection between opening statements and post-hearing briefs, and the effective use of exhibits and visuals. Session 3️⃣ focussed on cross-examination: how to effectively prepare, what style to use, knowing when to let go, character assassination, and lay and expert witnesses. Session 4️⃣ on ‘Oral advocacy at the main hearing’ examined witness examination (from counsel and tribunal perspectives) and the role of closing statements and post-hearing briefs, including the impact of transcripts, recency, and the current focus on expedited awards. Thank you speakers Ercüment Erdem, Luka Kristovic-Blazevic, Anne Véronique Schlaepfer, Reshma Oogorah, FCIArb, Ziad Obeid, Julie Spinelli, Jean Pierre Harb, and Yasmine Lahlou for this stimulating start to the 13th ICC MENA Conference on International Arbitration 🙌 Stay tuned for more updates on the Conference tomorrow! Abu Dhabi is today's epicentre of international arbitration, as the 13th ICC MENA Conference is taking place. The morning sessions ended; time for an overview. Sherif AKL, ICC Director for Arbitration and ADR for the Middle East, and Dr Mahmood Hussain, Chair of the ICC UAE Commission on Arbitration and ADR, gave welcome addresses. Then, Secretary General of the #ICCCourt Alexander Fessas provided key updates and insights from the ICC Court, highlighting recent developments and initiatives that enhance arbitration practices and services in the MENA region. ⚖️ Chair of the ICC Governing Body for Dispute Resolution Services Prof. Dr. Mohamed Abdel Wahab C.Arb, FCIArb then took the stage for the keynote speech. He said that the MENA region must move from regional participation to shaping global arbitration practices by modernising laws, building expertise, and addressing the challenges of ad hoc arbitration. He emphasised the need for regional collaboration, learning from examples like Latin America, and preparing for the impact of AI on dispute resolution, particularly in energy and construction sectors. Ultimately, he called for a shift from passive recipients to active contributors in the global arbitration landscape. 🌐 A presentation by ADGM Registrar and Chief Executive Linda Fitz-Alan followed. She declared that the UAE's booming economy, attracting global talent and investment, represents a golden age for international dispute resolution, driven by courageous leadership and innovation, not emulation, as they steer the future of arbitration with unparalleled service. 🚀 In the first panel session on “State Courts, Arbitration and the Middle East”, speakers Dr. Moosa AlAzri, Tarek Alkhayyat, Nabil Omran, and Girgis Abd El-Shahid addressed whether interactions between courts and arbitration proceedings are held in a climate that favours arbitration and addresses the reservations surrounding it. Additionally, the discussion analysed how these dynamics are shaping the arbitration landscape in the Gulf and beyond, particularly regarding the enforcement of arbitral awards and the broader implications for international arbitration. They concluded that substantial legal reforms are needed for arbitration to become a primary alternative to litigation. This requires embracing the principle of exceptional justice and adapting accordingly. ⚖️ Stay tuned for more updates on #ICCMENA later today. 🕔 #ICCArbitration ICC UAE ADGM
