  • This week, BWA TierOne Consult staff Sehan Wickramasinghe and Barry Worthington attended a panel discussion organised by RICS at Hall & Wilcox’s Melbourne office. The subject matter “Distressed Contracts and Appropriate Securities” comes at a particularly relevant time in the Australian construction and engineering sectors, following several (too many) high profile financial collapses of major Contractors. Those collapses have left significant problems in their wake for Clients, Subcontractors and Staff and wider community stakeholders. The panel discussion included highly practical examples of the early warning signs of a contracting party in possible distress, the degree of due diligence needed, both selecting a counterparty to a contract and in Contractors fully understanding / appropriately pricing contractual and/or delivery risk allocation, the pros and cons of alternative security mechanisms, and some encouraging examples of where (some) government clients are now taking a more balanced approach to risk allocation in their contracting arrangements with the industry. Credit is deserved in particular to Major Road Projects Victoria for leading by example in their recent collaborative Alliance contracting models that are now gaining pace in some of the smaller infrastructure upgrade projects.   • This week, we were delighted to sponsor Lighthouse Club Australia in its latest monthly panel discussion event, held at HFW.  Some of BWA TierOne Consult's staff Carin Campbell, Sehan Wickramasinghe and Barry Worthington all attended the event. The subject matter “Realities of Renewables Projects” was engaging, and topical to several of our current projects, where we are assisting our clients deliver new renewable energy infrastructure in a challenging environment.   • We are very pleased to welcome Sehan Wickramasinghe, who has recently joined BWA TierOne Consult as a Senior Consultant. Sehan has 13 years of experience across projects, both in Australia and overseas. He has undertaken numerous assignments for Tier 1 contractors, including John Holland Group, Lendlease, Downer/DTI, and CPB, in both the major commercial building and civil engineering infrastructure sectors. He has extensive experience in procurement and contract management across various methods, including PPP, design and construct, construct only, and lump sum contracts. Sehan is skilled in all project stages—feasibility, cost planning, tendering, contract negotiation, administration, and final account resolution—as well as managing claims and providing support for dispute resolution processes in various forums, such as adjudication, arbitration, and litigation. He is engaged by Western Sydney University to design and develop the core module “Construction and Claims” for the Master of Construction Law program and to deliver topics on quantum. Additionally, he serves as a member of the external advisory committee for the Master of Construction Law program. Sehan is hands-on and leads by example for the other staff on his team. He is a sought-after specialist commercial resource who brings his technical knowledge and experience to his clients. His academic and professional qualifications in quantity surveying, combined with secondary legal qualifications and extensive international experience, enable him to support his clients at any stage of a project in the planning and construction delivery process.
