The WA Department of Justice has become the first duty-holder in WA to be charged under the state’s WHS laws for not controlling psychosocial hazards (specifically, bullying harassment, sexual harassment and victimisation). It is alleged that the Department’s failure to implement appropriate procedures to address inappropriate behaviours in the workplace ultimately led to the psychological injury of a female prison officer at Bunbury Regional Prison, despite having received an improvement notice from WorkSafe WA. It has been reported that this marks the fourth prosecution by WorkSafe WA of the Department, which if convicted, a maximum $3.5million fine could be imposed under s31 of the Work Health and Safety Act 2020 (WA).
