The changes keep coming! The Migration Amendment (Public Interest Criteria 4005 and 4007) Regulations 2024 amend PIC 4005 and 4007 to allow minor visa applicants born and ordinarily residing in Australia with a health condition and/or a disability to "no longer be disadvantaged as part of their visa grant process solely due to that health condition or disability, and ensure fair and equal opportunity for settlement in Australia". This is a major development for visa applicants with children born and living in Australia who have health conditions and/or disabilities who may have, until now, been refused a visa as a result of the child's inability to meet the relevant public interest criterion. The Migration Amendment (Family Violence Provisions for Skilled Visa Applications) Regulations 2024 have been introduced, and will allow secondary applicants of skilled visa applicants to still be granted their visa if their relationship with the primary applicant has ended due to family violence. This will impact applicants for the below visas: • Employer Nomination Scheme (Subclass 186); • Regional Sponsored Migration Scheme (Subclass 187); • Skilled – Independent (Subclass 189); • Skilled – Nominated (Subclass 190); • Permanent Residence – Skilled Regional (Subclass 191); and • Skilled Regional (Subclass 887). This is a significant expansion and will allow for a secondary applicant to make a claim of family violence and, if they are found to have experienced family violence committed by the primary applicant, they may be eligible to be granted the visa. The government has repeatedly stated its position that a secondary applicant should not feel compelled to stay in a violent relationship for a visa outcome, and these changes will be a welcome development for many. #skilledvisas #immigrationlawyer #nomoslegal

NSW has opened its 2024-25 Skilled Migration Program, with some important changes for applicants: ➡ Published Skills Lists: NSW has reintroduced skills lists for both the Skilled Nominated Visa (subclass 190) and Skilled Work Regional Visa (subclass 491). Only occupations listed as eligible for each visa are considered for NSW nomination. ➡ NSW Priority Sectors: The program is targeting skill shortages in essential industries, namely Construction (infrastructure and housing), Renewables (net zero and clean energy), Care Economy (aged care and disability services, early childhood education and care sectors), Digital and Cyber (across all sectors), Education (teachers), Agriculture and Agrifood and Advanced Manufacturing. Invitation rounds will commence soon, so make sure that you meet the requirements for the program this year. The Minister for Education together with the Acting minister for Skills and Training and Minister Burke have today confirmed that, as foreshadowed in May, the government will set a National Planning Level ('NPL') for new international student commencements of 270,000 for calendar year 2025. This is subject to the passage of legislation. The aim of this initiative is to strengthen the integrity of the sector and to ensure a "managed international education system designed to grow sustainably over time." In media interviews, Minister Clare said the overall number of new international students next year would be roughly the same as in 2023, but students would be more evenly spread across the cities and regions. He rejected claims the caps would destroy Australia’s higher education sector. School students, higher degree by research students, students undertaking standalone English language courses (ELICOS), non-award students, Australian Government sponsored scholars, students that are part of an Australian transnational education arrangement or twinning arrangement, key partner foreign government scholarship holders, and students from the Pacific and Timor-Leste are excluded from the NPL. #internationaleducation #internationalstudents #immigrationlawyer #nomoslegal
