"We (...) adopted ex-ante regulation – the Digital Markets Act (DMA) and its companion, the Digital Services Act (DSA) – in a frenzy of enthusiasm and self congratulation (more Brussels effect!), and in the hope that setting out the rules of the game would induce Big Tech to play nice and comply with our European values spontaneously and good naturedly. But the reality of implementing the law has now revealed itself, and it’s clear that despite initial optimistic proclamations the law is not remotely self executing. Rather, it is every bit as hard to enforce as antitrust had turned out to be beforehand. (...) If we don’t own any of the infrastructure which is used to deliver services to Europeans, how do we ensure our autonomy and strategic independence in the face of growing risks? Ultimately, how do we protect democracy? Content moderation rules under the Digital Services Act (DSA) are not remotely enough either. What happens when (not if) the infrastructure which we rely on, but do now own, turns hostile? "Elon Musk has no easy way out of his fight with the European Commission, which is investigating whether his social-media site X breached rules designed to limit illegal content and disinformation. The billionaire is facing determined adversaries in the relevant Commissioners Thierry Breton and Margrethe Vestager, who have a new legal tool. Musk may eventually conclude that pulling the plug makes sense. The Commission last month issued a preliminary finding, opens new tab that X had breached the Digital Services Act (DSA), a sprawling new piece of legislation, opens new tab that aims to combat harmful online content. The joint civil society statement is in response to Commissioner Breton’s recent letter to X on the far-right riots in the UK and the live-streamed conversation between the U.S. presidential candidate Donald Trump and X owner Elon Musk. It is of the utmost importance to condemn the racist and Islamophobic violence in the UK. However, Commissioner Bretons’ letter remains silent on whether the serious risks of UK far-right riots taking place outside the EU have reached severe negative consequences for those within the EU jurisdiction.
