    🎉 Spark is proud to see our contribution to the evaluation of the #Antitrust Procedural Framework making an impact!   Spark assisted the European Commission (#DGCOMP) with the Support Study for the Evaluation of Regulations 1/2003 and 773/2004, as part of a consortium led by Deloitte Legal. We evaluated these Regulations in line with the #BetterRegulationGuidelines, focusing on their relevance, effectiveness, efficiency, coherence and EU-added value. 🔍📊 📄 The full report is now available on the European Commission’s website: https://lnkd.in/euTmUytZ

    🔴 The European Commission has published today a Staff Working Document summarising the findings of the evaluation of the EU antitrust procedural framework 👇 This evaluation focuses on Regulation 1/2003 and Regulation 773/2004, which establish the procedural framework for implementing EU competition rules under Articles 101 and 102 of the Treaty on the Functioning of the EU. 🔑These regulations have been instrumental in shaping EU antitrust enforcement during the last 20 years. Main findings of the evaluation ✨⬇ 📌 The Regulations have generally achieved their objective of effective, efficient and uniform application of EU competition rules. 📌 The two main changes brought about by Regulation 1/2003 were a success: I) the removal of the old system requiring the notification of agreements to the Commission for companies to benefit from an exemption under Article 101(3) TFEU, and II) the modernised system of parallel enforcement of EU competition rules by the Commission and national competition authorities (NCAs) and courts. NCAs have become key enforcers of EU competition law together with the Commission. 📌The evaluation also underlines the need for faster investigations. It identified several issues, some of which are connected to digitalisation, which may impact the effectiveness of investigation tools and powers that were written for ‘paper world’ investigations. Some aspects of cooperation within the ECN could also be improved further. The Commission collected evidence from different sources, including an external evaluation support study published today together with the summaries of the stakeholders’ workshop and the NCAs’ feedback 📂 📅 During the next months, the Commission will reflect on the evaluation results and decide whether to launch a process for the revision of the Regulations.     New study alert! 🚨 State liability and the preliminary reference procedure are essential tools for maintaining the uniform and effective application of #EUlaw across all Member States. We’re excited to announce that Spark will be producing concise, up-to-date country reports for each Member State for the European Commission (DG JUST).   • Exciting news from Budapest! 🎉 Our colleagues Célia Drevon and Matilde Paoloni joined the first meeting of the Expert Subgroup of the Working Group on Inspections organised by the European Labour Authority. The goal? To help update the Guidelines for concerted and joint labour inspections across EU Member States. The Guidelines support the national authorities involved in the inspections by delineating the different steps and promoting smooth cooperation. 🌍 At Spark, we're proud to assist ELA with several tasks including the revision of the Guidelines. We are grateful for the insightful discussions, and we're eager for what’s to come at the next meeting! 💼

    Spark keeps growing! ✨ Coming back from the summer break, we'd love to introduce you to our current trainees!   🌟 Maya is British-French and holds a Master's in EU law from the University of Amsterdam. She enjoys conducting legal research across different Member States!   💫 Imre is Hungarian and recently finished a Master’s in European Law at Leiden University. He enjoys working in a variety of areas, from energy and environment to justice and home affairs.     🤝 Marta comes from Spain and holds two Master's in EU and International law from the Universities of Granada and Groningen. She likes exploring different work cultures and gaining insights into EU policy-making and legal processes.    ⚖ Tania is from Romania and obtained a Master’s in European Law from Utrecht University. She enjoys working on tenders and contributing from their inception to the final outcome! 💡 Elena is Italian and holds two Master’s, one in Intellectual Property and Technology Law from the University of Illinois Urbana-Champaign, and one in Law from the University of Genova. She enjoys having the chance to work on several projects in different legal areas!      🌎 Benedetta comes from Italy and holds a Master’s in Global Governance Law from the University of Helsinki.   • Renewable energies are crucial for powering a more sustainable future! 💡 The amending Directive (EU) 2023/2413 on the promotion of energy from renewable sources (#REDIII) seeks to enhance the regulatory framework established in previous Directives.  It foresees increasing the share of #renewableenergy in the EU's energy mix, setting more ambitious targets for their use, and promoting their integration across various sectors, including 🔌 electricity; ❄ heating and cooling; and 🚗 transport. The Directive also aims to: ☀ Improve #energyefficiency;  ☀ Reduce greenhouse gas emissions; and  ☀ Foster innovation and investment in renewable energy technologies.  At Spark we are happy to work with the European Commission (DG ENER), conducting a compliance check of REDIII in the Member States and contributing to the EU's overarching climate and energy goals for 2030 and beyond. 🔍 Visit our website and find out more: https://lnkd.in/dgUdZqtz

  • 🙌 We're thrilled to announce that Spark is embarking on a new project with the European Commission (DG ENER)! 🎉 The new project will focus on Directive 2019/944 which aims to make electricity markets across Europe fairer, more competitive, and consumer-friendly. The Directive aims to set common rules for how electricity is generated, transmitted, distributed, stored, and supplied. 🔄 Spark has already worked with DG ENER on Directive 2019/944. We will be continuing our work by verifying and analysing that all 27 EU Member States have implemented the Directive correctly and adopted national measures to conform to its provisions.   • #AccesstoJustice is a fundamental right, that forms an integral part of public international law, including human rights conventions. ⚖ The European Commission Notice on Access to Justice in Environmental matters is an interpretative communication to provide both clarity and a reference source for Member State actors, including national courts, the public (individuals and #environmentalNGOs) and economic operators. 🍃   Spark assisted the European Commission (DG ENV) in analysing relevant #caselaw developments on the topic with the aim of updating the Notice in three key aspects: ♻ Legal Standing; ♻ Intensity of scrutiny and standard of review; and ♻ Criteria for assessing whether costs are prohibitive.
