Important Update to the High-Wage Stream of the Temporary Foreign Worker Program (TFWP) Starting November 8, 2024, changes to the wage threshold for the High-wage and Low-wage streams of the Temporary Foreign Worker Program (TFWP) will take effect. For the first time, the wage requirement for a position to qualify under the High-wage stream will increase by 20% above provincial median wages. This change affects 70% of High-wage occupations, which means that if wages are not adjusted to the new threshold, these positions will move to the Low-wage stream, triggering additional requirements. Key differences include: > Refusal to Process (RTP) policy in areas with unemployment above 6% (excluding healthcare, construction, and food processing sectors) > Cap on TFWs: 10% for most sectors, 20% for select industries > One-year work permits vs. three years for High-wage > Mandatory advertising to underrepresented groups > Additional worker protections and employer obligations. These updates align with the government’s goal to reduce temporary residents and ensure compliance, and they could significantly affect your talent management strategies. Join CERC’s Government Relations Committee as we break down the changes and discuss their potential impact on your organization. Key areas include: 1. Confirmation that the employer qualifies as a multinational corporation as defined in the program delivery update. 2. Ensuring that the foreign national is taking a position in Canada as defined in the program delivery update. 3. Confirming the foreign national will have a position to return to, in their home country, at the conclusion of the temporary assignment in Canada. 4. Confirming that a foreign national must meet the prescribed degree of specialized knowledge if coming under the specialized knowledge subcategory as defined in the program delivery update 5. More scrutiny in an application to show that the role is under the Canadian company’s direction and control, including a physical presence requirement for Canadian entities receiving the foreign national. 6. Intermittent travelers working on certain types of projects, etc. will be limited to a one-year work permit 7.
