    McCarthy Tétrault is pleased to announce that Sunil Kapur has been appointed to become the firm’s next Chief Executive Officer, effective January 1, 2025. Sunil will succeed Dave Leonard, who completes his second and final term as CEO on December 31, 2024. As the Practice Group Leader of the firm’s pre-eminent National Litigation and Dispute Resolution Group, Sunil oversees a diverse and talented team of approximately 300 litigators across Canada who represent clients in complex disputes both domestically and internationally. Sunil has more than 25 years of experience representing and advising clients, including many Fortune 500 companies, on sophisticated and high-stakes employment law matters. He has been at the forefront of many precedent-setting negotiations within the public and private sectors, with a keen understanding of clients’ business realities. His strong and principled leadership skills, sharp business acumen and innovative approach to client service will be invaluable to our firm and our clients.     On August 21st, the Federal Court of Appeal (“FCA”) allowed the appeal in President’s Choice Bank v His Majesty The King, 2024 FCA 135. The FCA overturned a decision of the Tax Court of Canada and concluded that President’s Choice Bank met all the requirements to claim notional input tax credits under s. 181(5) of the Excise Tax Act with respect to payments it made to reimburse Loblaws for discounts that Loblaws provided customers when they redeemed loyalty points at Loblaws stores.
