Arbitration Lab is a Swiss-British initiative bringing evidence-based analysis, big data and online technologies into the teaching, research and practice of arbitration. It conducts and supports events, publications and learning of international arbitration from a comparative perspective. Arbitration Lab brings together top experts on private and public adjudication from a variety of arbitration branches to transfer knowledge, skills and facilitate networking between senior and junior arbitration professionals. Launched in Basel, Switzerland by former classmates at Harvard Law School, who are now academics at leading Swiss and British academic institutions, Arbitration Lab plans to conduct training and conferences, research projects and work closely with dispute resolution institutions and legal practitioners. Its two flagship initiatives include a winter school in Basel and a summer school in London.

Arbitration and Territorial Disputes – Video of Closing Keynote by Prof Jure Vidmar is now available online This keynote was hosted by Osborne Clarke on 21 June 2024 as part of the 2024 London Summer Arbitration School. Greg Fullelove delivered the introductory remarks, Professor Yarik Kryvoi and Professor Anna Petrig co-moderated this keynote. This keynote considered the patterns, strengths and pitfalls of arbitrating territorial disputes. It focused on two main issues: how international arbitration is used as a method of peaceful settlement of territorial disputes and how arbitral tribunals address territorial disputes when settling other disputes (e.g. in investment arbitration). In the context of the use of arbitration as a means of peaceful settlement of territorial disputes, particular attention was paid to jurisdiction of arbitral tribunals, participation of states and non-states in the proceedings, the choice of law and the problem of enforcement. The lecture also addressed those situations where a territorial dispute appeared in arbitral proceedings incidentally and/or as an ancillary question. It discussed how arbitral tribunals ensured (or not) that they stayed within the boundaries of their jurisdiction; how they applied the rules of public international law, and what could be done in arbitration where these rules are inconclusive. Prof Dr Jure Vidmar is Chair of Public International Law at Maastricht University in the Netherlands. He is also a Member of the Permanent Court of Arbitration in The Hague, Member of the OSCE Court of Conciliation and Arbitration in Geneva, and is appointed by the European Commission to the List of Candidates Suitable for Appointment as Arbitrators and Trade and Sustainable Development Experts in Bilateral Disputes under Trade Agreements with Third Countries. '21st Century Arbitration: The Question of Trust in the Web3 Economy' – recording of the opening keynote address of the 2024 London Summer Arbitration School by Sophie Nappert is now available online. Sophie Nappert delivered the opening keynote address of the 2024 London Summer Arbitration School on 17 June 2024. Introductory remarks were delivered by Vlad Meerovich, Prof Yarik Kryvoi and Prof Anna Petrig co-moderated the keynote and the discussion, which followed. The keynote examined the ways in which the arbitral process might adapt to be relevant to the values of the Web3 economy, and notably by taking a fresh look at due process. As ways of doing business evolve, as new types of commercial transactions emerge, so the nature of the disputes arising out of these transactions changes, as does the vector for their resolution. Just as commercial arbitration historically flourished because industry-specific disputes demanded decision-makers who were knowledgeable in the given industry and respected by their peers, so the current reality of e-commerce is giving rise to a new breed of cross-border, high-volume, low-value, one-shot disputes. The resolution of such disputes through traditional processes are ill-suited, premised as they are on due process measures that are time-reliant. This increasingly dominant voice in the marketplace prompts the question whether a less time-consuming approach to arbitration’s traditional reliance on due process, leveraging technological tools, might constitute an acceptable trade-off to elicit a speedier, consensus-based, cheaper decision, thereby delivering more satisfaction to e-commerce users, and thus garnering more trust.
