Charged today with promoting and implementing worldwide the industry's strategic goals on behalf of Member Associations representing the majority of consulting engineering firms supplying services on a fee basis. The consulting engineering industry sees beyond the technical aspects of infrastructure development and resource management to the social and environmental obligations of sustainable development, the most important criterion for project acceptability. FIDIC seeks a business environment characterised by professional competence, impartial advice and open and fair competition.

Here are the key takeaways: Session 6: Navigating Conflict Management, Dispute Avoidance, Dispute Boards and Arbitration This session emphasised the importance of internal company policies and practical tools for early dispute management and settlement facilitation: ✅ Early Warning Systems: Proactively managing risks by implementing early dispute warning systems and internal review mechanisms. ✅ DB Decisions: Compliance with Dispute Board decisions is influenced by financial considerations, reputation and the risk of project delays. ✅ Mediation Windows: Mediation and settlement windows are most effective when introduced early in arbitration. Session 7: Disruption This session explored disruption in construction projects and how to prove disruption claims successfully: ✅ Clear Documentation: Accurate records are critical to proving loss of productivity and disruption. ✅ Proving Disruption: Demonstrating a clear link between disruptive events and loss of productivity is essential for a successful claim. ✅ Disruption vs. Delay: Disruption relates to inefficiency and increased costs, while delay impacts the project timeline. Here are the key takeaways from these two engaging discussions: Session 5: Part I – Recent ICC and FIDIC Highlights This session focused on updates in FIDIC contracts and ICC arbitral awards, as well as best practices for conflict management and dispute avoidance. ✅ Global Reach: FIDIC contracts are used in 170 countries and translated into 28 languages, including Korean. ✅ Construction Leads ICC Cases: about 46% of ICC expert cases from 2018-2023 involved construction. ✅ Dispute Avoidance: FIDIC's new Practice Note aims to prevent disputes and improve resolution through Dispute Boards.
