No - search engines are not unlimitedly liable for any content that comes up in search results. 📢 👉🏼 In a recent decision, the Zurich Commercial Court ruled that search engines like Google are not automatically liable for all content appearing in their search results. This decision, which is now binding, reinforces the legal principles of limited liability for search operators—especially when users actively search for specific terms that drive those results. In this case, Google was under scrutiny for articles related to FIFA, which appeared only when certain keyword combinations were entered. The court found that Google’s role as a search engine did not constitute causal involvement in any potential personality infringement claims, as users determined their own search results by actively seeking specific content. ➡️ As a consequence, Google was not ordered to delist the search results from its search engine. Ralph Schlosser and Maud Fragnière were honoured to assist Google in this victory!
