Following the submission in April 2024 of the Anti-Money Laundering Law of the People’s Republic of China (Revised Draft) (“First Draft”) to the Standing Committee of the 14th National People’s Congress for initial review, on September 13, 2024, the 11th Session of the Standing Committee of the 14th National People’s Congress conducted a second review of the Anti-Money Laundering Law (Revised Draft for Review) (the “Second Draft”). It will solicit public comment until October 12, 2024. The proposed amendments in the Second Draft have the following notable highlights: it emphasizes the principles of proportion, accuracy and precision of anti-money laundering measures to strike a balance between financial institutions’ management of money laundering risks and the optimization of their financial services, aiming to minimize the impact on legitimate financial activities, and emphasizes the need to respect and protect individual privacy. 

With the rapid advancement of AI technology, generative synthesis tools have become more realistic, increasingly accessible and user-friendly. As a result, the ability to create and disseminate deepfake content at low cost has blurred the lines between reality and the virtual world, posing challenges to the traditional distribution of information on the internet. In September, China Central Television (CCTV) reported that criminals in various regions of China had used “face swapping” technology to forge indecent photos and manipulate victims’ selfies from social media for blackmailing purposes.

JunHe’s Hong Kong and Shanghai Teams Advise Laohekou Highway on its First Offering of Dim Sum Bonds In August 2024, Laohekou Highway Construction Co., Ltd. (“Laohekou Highway”) issued RMB 144 million senior unsecured offshore bonds through Laohekou Highway International Limited, its wholly-owned Hong Kong subsidiary. The bonds will mature in 364 days and were listed on the Stock Exchange of Hong Kong on August 7, 2024. This was the first successful offshore bond issuance within Xiangyang City, Hubei Province. In August 2024, Laohekou Highway Construction Co., Ltd. JunHe Advises Tsinlien Group‘s Offshore Sustainability-Linked Syndicated Loan In July 2024, Tsinlien Group Company Limited (“Tsinlien Group”) successfully completed a HK$538 million equivalent offshore sustainability-linked syndicated loan, which was jointly certified by the Hong Kong Quality Assurance Agency and CCX Green Finance. The loan was well received by the market: six domestic and overseas banks confirmed their subscription to the loan and there was an over-subscription rate of 2.04. JunHe Advises Nanyang Transportation Holding on its Issuance of RMB 1,288 Million Offshore Sustainability Bonds In August 2024, Nanyang Transportation Holding Group Co., Ltd. (“NTHG”) issued RMB 1,288 million sustainability-linked senior unsecured offshore bonds, with an interest rate of 6% and a maturity of three years (the “Bonds”). Lianhe Green Development Company Limited issued second-party opinions on the sustainable finance framework of NTHG. The Bonds were listed on the Chongwa (Macau) Financial Assets Exchange on August 30, 2024. (hereinafter referred to collectively as the “Companies”) in receiving ISO 37301:2021 and GB/T 35770-2022 compliance management system certifications from the China Quality Certification Center (CQC). In previous judicial practice, enforcement judges were required to physically visit the location of a real property in order to carry out a cross-regional seizure. However, these judges often faced challenges such as heavy caseloads and limited personnel, which could result in delays in property preservation for investors. These difficulties were further exacerbated in cross-regional cases due to delays in document service. On February 7, 2024, the Supreme People's Court and the Ministry of Natural Resources issued the "Notice on Carrying Out the Pilot Work of 'Head office-to-Head office' Online Seizure Registration of Real Property" (Fa [2024] No. 32) (the "Pilot Notice"). This stipulates the methods for online seizure registration and aims to reduce the difficulty of cross-regional seizures, enhance judicial efficiency, and lay a practical foundation for a nationwide online seizure registration mechanism.
