🔊 ECHA fees for biocides are about to change🔔 The European Commission is preparing an amendment to regulation (EU) 564/2013, to account for the inflation of the past years. In order to perform this review, the fees were adjusted in accordance with the average annual inflation rates for 2021, 2022 and 2023, as published by Eurostat, so as to reflect the cumulative inflation rate of 19,5%. Big changes ahead for ethanol under the BPR—businesses need to stay ahead of the curve! 🚀 What are your thoughts on this potential shift in regulations?
🚨 Navigating the Regulatory Landscape: Ethanol under the BPR 🚨 With the European Chemicals Agency (ECHA) recently opening a public consultation to consider Ethanol as a candidate for substitution under the Biocidal Products Regulation (BPR, Regulation (EU) No 528/2012), the regulatory environment is evolving rapidly. For companies manufacturing or distributing ethanol-based biocidal products, this decision could have significant implications. 📍 The Challenge: Ethanol, widely used for its antimicrobial properties in Product Types 1, 2, and 4, is now being assessed to determine whether its risks justify replacement with safer and more sustainable alternatives. Due to Ethanol being regarded as candidate for substitution, companies could face restrictions on its use and be required to invest in alternative substances or reformulate existing products. 📌 Current Status: Greece, as the evaluating competent authority, submitted a revised dossier in March 2024. The Biocidal Products Committee (BPC) Working Groups concluded in October 2024 that Ethanol meets the exclusion criteria for reproductive toxicity and carcinogenicity and is still undecided about mutagenicity. Subsequently ECHA has launched a public consultation to gather input on potential alternatives to ethanol in biocidal products, including hand as well as surface disinfectants in both public and food / feed producing areas. The deadline for submitting comments is 28 April 2025 and the final decision on the approvals is expected in the second half of 2025. ⚠️ Potential Reclassification Impact: A potential reclassification of ethanol according to the CLP regulation due to the observed reproductive toxicity and carcinogenicity after ingestion not only has a severe impact on products used for disinfection but also products that use ethanol as a solvent or carrier (e.g. repellents). Despite ethanol being safe in cleaning, disinfection, and other household products due to denaturation (which prevents oral consumption), the reclassification could still limit its use.
