Viimase kolme aasta jooksul NJORD Advokaadibüroo ,ühe väljakutseterohke töö käigus, kogesin, kuidas esmapilgul uskumatuna tunduv iga järgmise sammuga aina valusamaks reaalsuseks muutus. Koostöös kolleeg Ann Tarkin suutsime tõestada, et Eesti ühe vanima investeerimisühingu sees ei toimunud varade investeerimine, vaid investorite raha kandmine enda ühest taskust teise. Olenemata kõikidest punastest lippudest, mis Cresco Väärtpaberid AS-i ümber aastaid lehvisid, suutis antud ettevõte oma tegevust varjata nii Finantsinspektsiooni kui ka investorite eest. Tagajärjeks on kahjud, mis ulatuvad miljonitesse eurodesse ja pankrotis investeerimisühing. Hetkel vaatab ajutise pankrotihalduri raportist vastu tõsiasi, et Cresco Väärtpaberid AS-i kaudu pole suudetud ühtegi (edukat) investeeringut teha. Seda olenemata tõsiasjast, et viimase kümne aasta jooksul on peaaegu kõikide varaklasside hinnad kordades oma väärtuses kasvanud. Cresco Väärtpaberid AS on suutnud neile usaldatud miljonitest eurodest säilitada vaid mõnikümmend tuhat eurot pangakontole, mis on kohtutäituri poolt arestitud. Lootus on, et pankrotimenetlus annab vastused, kuhu raha kulutati ja kas maksejõuetuse põhjus võib olla kuriteo tunnustega tegu. ENG Over the past three years, in the course of one of the challenging works, I experienced how at first glance the conclusions about what is happening, which initially seemed unbelievable, have become an increasingly painful reality with each subsequent step. Together with my colleague Ann Tarkin we were able to prove that one of the oldest investment companies in Estonia did not invest any investors’ money but transferred it from one pocket to another. Regardless of all the red flags that have been flying around Cresco Väärtpaberid AS for years, this company was able to hide its activities from both, the Financial Supervision Authority and investors. The consequence is losses amounting to millions of euros and a bankrupt investment firm. Currently, the interim bankruptcy trustee's report reveals that no successful investments have been made through Cresco Väärtpaberid AS. This is despite the fact that in the last ten years, the prices of almost all asset classes have increased significantly. Cresco Väärtpaberid AS has managed to retain only a few tens of thousands of euros from the millions entrusted to them, which is now seized by the bailiff. The hope is that the bankruptcy proceedings will provide answers as to where the money was spent and whether the cause of insolvency might be an act with criminal elements. European Innovation Council (EIC) has decided to honor Mifundo with a grant of €2.5M plus equity investment from its prestigious EIC Accelerator program. 🌟 What an insightful weekend for NJORD's dispute resolution partner Triinu Hiob in Georgia! 🌟 We are thrilled to share that Triinu had the honor of moderating a panel at the ICC Arbitration & International Chamber of Commerce in Georgia conference in Tbilisi on June 14th. The panel focused on recent developments and challenges in arbitration. Triinu found it particularly fascinating to discover that a recent arbitral award in Lithuania was denied recognition and enforcement due to sanctions. Additionally, she learned that Kyrgyzstan allows a wide range of disputes to be resolved through arbitration. Another memorable highlight was joining the Georgian Association of Arbitrators on a hike to celebrate the #NewYorkConvention's 66th anniversary. The stunning Georgian mountains were unforgettable. What a weekend it was, full of interesting discussions about arbitration, making new acquaintances and spending quality time in beautiful Georgia! 💚 Last Friday 14 June I had the pleasure and honor of moderating the panel about recent developments and challenged in arbitration at the ICC Arbitration and International Chamber of Commerce in Georgia conference "Arbitration & ADR in Georgia and the Wider Region" in Tbilisi. Thank you for your thought provoking insights, Renata Berzanskiene, Natalia Alenkina, Giorgi Batlidze and Hayk Hovhannisyan. It was especially interesting for me to learn that recently an arbitral award was refused recognition and enforcement based on sanctions in Lithuania, and that in Kyrgyzstan such a broad variety of disputes is arbitrable. NJORD's partner Triinu Hiob and associate Karl-Enrik Kriis had the pleasure of attending the Willem C. Vis Moot Team Tartu's appreciation event. NJORD has been a long-time supporter of the team and was thrilled to witness their progress and dedication first-hand. The Willem C. Vis International Commercial Arbitration Moot is the world's largest moot court competition, attracting 373 teams and over 2,500 law students this year. The event also featured approximately 1,600 arbitrators from both professional and academic backgrounds. Triinu Hiob had the honor of serving as an arbitrator in the final rounds.
