The visit provided a fantastic opportunity to collaborate on ongoing projects and hold productive meetings to further strengthen our teamwork across regions.     The European Commission has now published a comprehensive FAQ document with "preliminary views" on the #ESPR framework. It follows an online information session held on 22 May. The FAQ addresses 171 questions concerning the scope of the regulation, interplay with other laws and various aspects concerning its upcoming implementation. Here are my TOP10 highlights, especially from our chemicals point of view at REACHLaw - Your Partner In Chemical Regulatory Compliance and Sustainability: 1️⃣ Substances and mixtures themselves will not be required to have a DPP, unless another specific law requires otherwise, or unless they will be regulated under the ESPR (FAQ #46). In the latter case, the compliance obligation will be with the supplier of the regulated product (FAQ #81). 2️⃣ The ESPR is complementary to chemical legislation. The EC will have to consider chemical safety aspects for ESPR in order NOT to increase risks (FAQ #120). 3️⃣ Ecodesign measures may foresee that supply chain actors provide, free of charge, information on what they supply, such as the chemical composition of materials used or the production process employed (Recital (77), Article 38, FAQ #55) 4️⃣ Commission services are considering the specific features of intermediate products (such as chemicals) for the definition of ecodesign requirements (FAQ #91) - a "cradle-to-gate approach" is being discussed (FAQ #82). 5️⃣ "Substances of Concern" (SoC) are addressed in extenso (see Chapter 10). Orders of magnitude are given for the first time (FAQ #111). The precise lists will likely be different per product group, and may change over time. 6️⃣ The entry into force of the first ESPR delegated acts, including provisions on substances of concern, is expected mid-2027 (FAQ #104). 7️⃣ The EC aims at a progressive alignment and integration of SCIP with the DPP as far as technically possible, to avoid double regulation (FAQ #121). 8️⃣ "Horizontal requirements" can concern products and aspects not included in the working plan, but still included in the ESPR scope (FAQ #75). 9️⃣ Interested companies should look out for the EC call for applications for membership in the Ecodesign Forum and the final JRC report on product priorities. Both are still scheduled for Q3/2024 according to the FAQ. 🔟 "Too early to tell"... pops up in several answers, such as concerning third party verification and conformity assessment on the information disclosed in the DPP, and information on SoCs to be included.
