🌎 On March 6 in Lima, the NEC Contracts® will launch the official translation into Spanish of NEC4 contracts, starting with the Engineering and Construction Contract (ECC), as well as the accompanying guidance notes and training. The President of the Confederation of International Contractors' Associations (CICA), Juan Armando Vicuña Marín, will attend the event. 📄 In that context, Fanny Dastugue, Director General of CICA, wrote an article for REVISTA NEGOCIO & CONSTRUCCIÓN and spoke with Rekha Thawrani OBE to understand how the collaborative contracting approaches are being implemented in Peru. Fanny also discussed with a local contractor, Alvaro Beckdorf Altschwager from Grupo Flesan Perú, who has an extensive experience of NEC contracts in Peru. And a local consultant, Augusto Gutiérrez Zuzunaga, NECReg. Among the different features of collaborative contracting, CICA delved into the concept of Early Contractor Involvement with some highlights from Gabriel Armanet, FCIArb, MRICS and explored a case study of BESIX in Brazil. ✅ Developing standard forms for collaborative contracting can save time and money, leave less room for disputes if the standard forms are not amended, and preserve the initial and fair balance of risks. ➡️ While the gains from collaboration should also be checked against the costs of initiating and administrating the collaborative framework, it can be demonstrated that collaborative processes can benefit smaller projects by leveraging the multidisciplinary expertise of all the parties involved. ✅ Collaborative approaches may drive innovation and facilitate compliance with the requirements for the decarbonization of the projects considering the whole life-cycle of the infrastructure as sustainable design relies critically on knowledge found in supply chains. Collaboration to adapt the quantities to the strict needs of the projects can limit wastage significantly. ➡️ It is needed to instill pragmatism and promote a less adversarial and more tailored approach to meet the needs of the projects, and maximize the Value-for-Money. Moving from the lowest cost approach to quality would be a positive signal. ➡️ Choosing the right partners with the right skills from the outset remains a key driver of success and shall be a way to attract young and diverse talents to the construction industry. PIARC's Technical Report "Well-Prepared Projects in Low- and Middle-Income Countries" is now available in English, French and Spanish! Prepared by PIARC's Task Force 1.3 under the leadership of Michel Démarre, who also chairs CICA's Well-Prepared Projects Working Group, the report explores how changes introduced by MDBs may affect project preparation, along with the impact of newly established organizations — such as the Blue Dot Network and FAST-Infra Group — that prioritize Quality Infrastructure Investment. 📢 On February 21st, CICA was pleased to join King's College London conference on the evolving role of development banks in construction procurement, contracting, and achieving net zero. The discussions highlighted key challenges and opportunities in global infrastructure projects, particularly concerning procurement frameworks, competition, and sustainability. ✔ World Bank Procurement Updates: From March 1st, the WB will introduce new rated criteria in procurement, aiming to shift away from a low-bid-dominated system and encourage fairer competition. ✔ Sustainable Infrastructure Strategies: The EBRD outlined its approach to enhancing connectivity, climate resilience, and sustainable public procurement through digital solutions and private sector involvement. ✔ The Shift from Lowest Price to Lifecycle Approach: Discussions focused on moving towards quality-based procurement that considers the entire lifecycle of infrastructure projects, rather than just initial costs. ✔ Alliance Contracts & Risk Sharing: Multiparty framework contracts FAC-1, NEC4, or FIDIC’s Green Book (2021), were discussed as ways to improve transparency, reduce risks, and enhance cooperation. ✔ Net Zero: For example, the UK mandated net zero by 2030, showing the global construction sector engagement. ✔ Procurement is not only an administrative tool, it can be transformative and strategic. The earlier the supply chain involvement is, the more value can be unlocked. CICA Vice-President Philippe Dessoy had the opportunity to share the contractors' views on that day. He reminded the audience with the everyday concerns of contractors (low margins, high risks, and unfair competition, particularly in the wake of aggressive low-cost bids) and advocated for stronger collaboration between contractors, MDBs, and procurement authorities to combat unfair competition. As an example, Philippe Dessoy presented the Portonave quay wall improvement in Brazil using Early Contractor Involvement (ECI, Besix). 🤝 For improved collaboration, the use of Dispute Boards early in the projects can be key. Jeremy Glover, on behalf of CICA, EIC and DRBF, addressed the practical challenges faced by Dispute Boards, with recommendations for improvement.
