[#GideRealEstate] 📣 Société à prépondérance immobilière : les juges du fond confirment l’analyse du Conseil d’Etat concernant la convention franco-belge En 2020, le Conseil d’Etat avait jugé que la convention fiscale applicable entre la #France et la #Belgique ne faisait pas obstacle à l’imposition en France de la plus-value réalisée par un résident belge sur la cession de parts d’une société civile immobilière française à prépondérance immobilière alors que les praticiens s’accordaient jusque-là pour considérer que ces plus-values n’étaient taxables qu’en Belgique. 💡 Le Tribunal administratif de Montreuil a confirmé cette analyse dans un jugement du 6 juin 2024.
