    Over the weekend, the US implemented the tariff increase sought by its new President. In practical terms, this means that imports of goods from Mexico and Canada will be subject to a 25% tariff (with a few exceptions in the energy sector). Similarly, imports from China will also be subject to a 10% tariff. Even if the European Union is not yet ‘formally’ affected by these tariff hikes, the American President said publicly that EU tariffs increase will follow soon. Alongside these tariff increases, we should not forget the two notices of proposed rulemakings concerning the de minimis import regime. First rulemaking, named “Entry of Low-value shipments” would establish a dual track entry process for de minimis shipments: Maintaining and revisiting the basic entry process (i.e release from manifest process but with request of additional data for low value goods) and creating a dedicated “enhanced” entry process (i.e combination of successful aspects of the Section 321 Data pilot and Entry Type 86 Test with requirement of additional data about content, origin and destination of the shipments). On top, this document proposes to define who is the “one person” to whom the $800 exemption applies, explain eligibility requirements for the exemption and clarify the definition of a “shipment”. Second rulemaking named “Trade and National Security Actions and Low-Value Shipments” would establish (i) an ineligibility to use this low-value goods exemption, for goods subject to specific trade or national security actions (merchandise subject to an ad valorem tariff under Section 232,201 or 301) , and(ii) require that certain shipments claiming this exemption provide the 10 digits Harmonized Tariff Schedule of the United States (HTSU) classification of the merchandise.
