The 13th ICC Brazilian Arbitration Day continued with a panel on “The Bare Minimum”, exploring award efficiency. This session started with a presentation by Andrés Jana on the study “The Bare Minimum: Cost-Efficient Awards for Disputes of Small– and Medium– Sized Enterprises” which you can read at https://lnkd.in/eA7u5Jp2 📖 The panellists, also including Maria Claudia Procopiak, Débora Lunardelli Djehdian, Guilherme De Paula Nascente Nunes, and moderator Isabela Lacreta, stressed that thoroughness doesn't equal length; awards should respect legal seats and party expectations, focusing on essentials. Next panel, "The transformation of arbitration within the energy industry", moderated by Julie Bédard, addressed the shift from oil and gas to renewables. 🌱 In-house lawyers Marcela Sussekind Veríssimo, Hannah Tung, and Lucas Barreto Ribeiro discussed ESG claims, climate change, and harmonising arbitration clauses. Fabrício Zaluski highlighted how lengthy arbitrations impact project financing. All agreed arbitration remains the best technical solution. The final panel, moderated by Marcela Levy, focused on corporate disputes. Marina Palma Copola de Carvalho, Guilherme Carneiro Monteiro Nitschke, and Nelson Eizirik shared Brazilian experiences, while Gabriela Alvarez Avila offered a Mexican perspective. 🌎 Particularly, the speakers referred to dispute resolution systems for both individual and collective actions. A specific aspect discussed was whether arbitration agreements applied to incoming shareholders. Also, they referred to the interaction of arbitration with corporate and civil law, including questions of direct and indirect damages, reflecting on the relationship between the corporation and its shareholders. Alvarez pointed out that corporate claims can even lead to investment arbitrations. Alexis Mourre's keynote on AI in international arbitration concluded the day. 🤖 He argued AI decisions aren't arbitration, emphasising "the algorithm should not replace arbitrators." However, he acknowledged AI's necessity, calling for binding, flexible, and demanding rules for arbitrators from arbitral institutions. In conclusion, the day's discussions highlighted the evolving landscape of arbitration, balancing efficiency, technological advancements, and the enduring importance of human judgment. As we move forward, embracing innovation while maintaining core principles will be crucial for the future of dispute resolution. We thank our speakers, the participants, and the sponsors. Happening now: the 13th ICC Brazilian Arbitration Day ⚖️ Almost 500 legal professionals and business leaders are gathering today in São Paulo for a sold-out edition of #BAD2025. So far, the audience could enjoy welcome addresses by Gabriella Dorlhiac, Executive Director of ICC Brazil, and Gabriel Costa, Associate General Counsel Global Litigation at Shell Brasil Petróleo Ltda. & President of the Arbitration and Mediation Commission 2024/2025 at ICC Brazil. This was followed by opening remarks by Alexander Fessas, Secretary General of the ICC International Court of Arbitration & Director of ICC Dispute Resolution Services, and Ana Serra e Moura, Deputy Secretary General at the ICC International Court of Arbitration. Mr Fessas emphasised the “glocal” character of ICC, being a global institution but with a local practice. He mentioned that the Brazilian arbitration model is a very successful one, worthy of being adopted in other countries as well. Currently, Alice Moreira Franco, Partner at FCDG, and Fabiano Robalinho Cavalcanti, Partner at Bermudes Advogados, are interviewing Adriana Maia Venturini, Procuradora Geral-Federal at AGU. Panels on the bare minimum for awards, the transformation of arbitration within the energy industry, and dispute resolution for corporations are scheduled to take place later today, as well as the keynote speech by Mourre Alexis, Founding Partner at Mourre, Chessa, Le Lay Arbitration & former ICC Court President, and concluding remarks by Patrícia de Figueiredo Ferraz, ICC Director for Arbitration and ADR for Latin America.
