Ο ν. 5123/2024 εισήγαγε ένα ενιαίο και συνεκτικό νομοθετικό πλαίσιο σχετικά με την εμπράγματη ασφάλεια του ενεχύρου. Το νέο πλαίσιο προβλέπει – μεταξύ άλλων – τη θεσμοθέτηση Ηλεκτρονικού Μητρώου Ενεχύρων, στο οποίο θα καταχωρίζονται όλες οι πράξεις που αφορούν στα ενέχυρα, διασφαλίζοντας τη δημόσια πίστη και την ασφάλεια των συναλλαγών. Επιπλέον εισάγεται νέα διάταξη με βάση την οποία ο δανειστής δύναται να εισπράττει μόνος του την απαίτηση του, με την παρέλευση δέκα εργασίμων ημερών από τότε που κατέστη ολικά ή μερικά ληξιπρόθεσμη. --------- Law 5123/2024 introduced a unified and coherent legislative framework regarding the in rem security of pledges. The new framework provides, among other things, for the establishment of an Electronic Registry of Pledges, where all transactions related to pledges will be recorded, ensuring public trust and transaction security.
