The Data Protection Commission is Ireland’s independent supervisory authority tasked with upholding individual data protection rights and regulating the data processing activities of the organisations operating within our jurisdiction. The DPC is the Irish supervisory authority responsible for monitoring the application of the General Data Protection Regulation (GDPR), and we also have functions and powers related to other regulatory frameworks, including the Irish ePrivacy Regulations (2011) and the EU Directive known as the Law Enforcement Directive (LED). The statutory powers, duties and functions of the DPC are as established under the Data Protection Act 2018. They should take every reasonable step to ensure that personal data that are inaccurate, keeping in mind the purposes for which they are processed, are erased or corrected without delay. Is conducting a DPIA mandatory? A DPIA is mandatory where data processing is likely to result in a high risk to the rights and freedoms of natural persons. In cases where it is not clear whether a DPIA is strictly mandatory, carrying out a DPIA is still good practice and a useful tool to help data controllers comply with data protection law.
