The number of personal injury claims made to the Injuries Resolution Board last year rose 10%. However despite the increase, the total volume of claims at 20,263 remained 35% lower than in 2019. The Competition and Consumer Protection Commission (CCPC) has highlighted a consultation process recently opened by the European Commission on parts of EU competition law. The consultation covers draft guidelines produced by the commission aimed at clarifying the application of article 102 of the Treaty on the Functioning of the European Union (TFEU). The CCPC points out that EU competition law is mainly covered by articles 101 and 102, but that there are currently no guidelines on enforcing the latter. https://lnkd.in/eMVpCsva

Earlier this year after he was elected Taoiseach, Simon Harris requested a review of the current Stamp Duty. At the time, he suggested that the 10% rate had not been entirely successful in its goal of curbing the bulk buying of new homes needed for first time buyers. This summer legislation regulating assisted human reproduction (AHR) and surrogacy arrangements was approved by the Oireachtas. Only the biological fathers of children born via surrogacy have been recognised as the parents in Irish law. The mothers, or in the case of same sex male couples second fathers, have only been able to get guardianship of their children. Once the bill has been signed into law, these parents can apply to the High Court for parental orders to secure parentage. https://lnkd.in/eTxFW8Pg

Minister for Enterprise, Trade and Employment, Peter Burke TD, has secured government approval to commence drafting of the Miscellaneous Provisions Bill (Registration of Limited Partnerships and Business Names). The proposed Bill would repeal and replace the Limited Partnerships Act 1907 and the Registration of Business Names Act 1963. Both Acts require updating to provide for modern business practices for those engaged in business using a business name or the limited partnership model. https://lnkd.in/eFGhWFj3

The Minister for Housing has signed an order putting into effect new legislation on tenancies and licences for student-specific accommodation. Darragh O’Brien said that the bill was a response to a move by some private accommodation providers to implement a 51-week occupancy model. https://lnkd.in/eagnSE9Z

The Society of Chartered Surveyors Ireland and the Law Society of Ireland have published a consumer guide which identifies the causes of delays when buying and selling a property in Ireland. The guide is primarily aimed at sellers but will also be of interest to buyers. Its aim is to speed up property sales, which is averaging at over four months, but can be much longer. https://lnkd.in/eyuwKm2W
