A day with a dynamic group of people applying their experience and distinct lens to issues at the intersection of Law/justice systems and the environment. “There is a lot of difference in soil and water conservation trenches that people build in their villages to get employment from the state and the trenches they have proposed and built, because they know it will replenish their well for years to come. The difference is ownership: in the former instance, they are doing work on a project controlled by the state to earn a day's wages from it; in the latter, it is their own land they are taking care of, with the knowledge and anticipation of future benefits.” During the Agami Summit 2022, IAS officer Dr Mittali Sethi shared the long term impact of participatory processes in decision-making. Even more so when it is a question of the quality of life and relationship with one's immediate natural environment. During her tenure as Assistant Collector, Amravati District (2019-21) she closely observed the realities of the verdant Melghat region of Maharashtra. On one hand there were issues of annual distress migration, subsequent disruption of public services and communities’ estrangement from the forest and its resources. And on the other was the richness of the land, the potential to generate sustenance and the opportunity for strategic policy for positive impact. As a response to this, Mittali and her team brought together two laws - NREGA and FRA, particularly its Community Forest Rights provisions, to empower local communities. The convergence was successful in reversing migration, incentivising conservation efforts thereby re-establishing people’s historical relationship with the land and bringing in the voices, needs and aspirations of people when determining their future. This creative interpretation and implementation of laws and existing provisions to address realities of the ground are as crucial as reforms to our existing system. How are justice and walking related? And why does India need more river walkers? Eight fellows walked along the river Luni in Rajasthan through the months of February and March 2024 in the latest edition of the Moving Upstream fellowship conceived by Siddharth Agarwal and jointly hosted by Veditum India Foundation, School of Public Policy, IIT Delhi, A4STORE and Out of Eden Walk. Their encounters with human and non-human lives that are a part of the riparian ecosystem are intertwined with personal negotiations, challenging assumptions and reinforcing the sentience of the river. These journeys on foot blurred the boundaries between the internal and external - the self and the environment - a a crucial convergence for a fundamental shift in how we relate to the environment. And subsequently how we engage with it. In the summer of 2023, we began exploring the workings of justice in the context of the environment. ❓The question we posed to experts and community members was - what does creative and effective problem-solving look like at the intersection of justice systems, both formal and informal, and the environment? ✨ A recurring pattern in their responses was the inextricable link between justice for people and justice for the environment and how a cognisance of and balance between both is crucial. While we have the vocabulary to understand the ways in which justice plays out at the societal level, there is a vast chasm in our ability to understand the needs, rhythms and realities of the non-human living world. This gap reflects in the many forms of system that govern us and the environment. When Arjun Singh of Ecological Restoration Alliance (ERA) introduced us to Ecologist Aparna Watve and Activist-lawyer Hema Ramani's efforts towards restoring the Panchgani Tableland, what struck us was their approach to addressing the gap. One that placed the sentience of the Tableland at the centre and drew from their respective expertise and distinct ways of relating to it. Their story spoke of the evolution of an environmental changemaker and how this space can only benefit from an openness to unlearn, cross-disciplinary collaboration and a deep, deep empathy for the living world.
