Quick Update: The Supreme Court of India in Pro Knits v. The Board of Directors of Canara Bank held that the procedure for restructuring of loans under the Framework for Revival and Rehabilitation of Micro, Small and Medium Enterprises is to be mandatorily followed by banks and non-banking financial institutions before categorising MSME loan accounts as non-performing assets. However, the court noted that MSME companies are required to provide the requisite documentation to avail the benefits of restructuring under the Framework. Quick Update: On September 09, 2024, the Supreme Court in the case of Chalasani Udaya Shankar v. Lexus Technologies Private Limited (2024 INSC 671), established that if an open-and-shut case of fraud is made out in favour of the person seeking rectification of the register of members of a company, the National Company Law Tribunal would be entitled to exercise its power to direct such rectification under Section 59 of the Companies Act, 2013. The jurisdiction of any other forum would be completely barred only when the subject matter squarely falls within the exclusive jurisdiction of the NCLT or the dispute in question, falls outside the realm of the particular provision under Companies Act, 2013.
