India’s commerce minister has stirred a debate by condemning online platforms like Amazon for their "predatory pricing" strategies that harm small businesses. In a detailed conversation with South China Morning Post SCMP, our Partner Siddharth Mahajan stated said the government had been working on an e-commerce policy that was “expected to cover a lot of issues related to predatory pricing and discounting”. He further added that the foreign-owned online retailing platforms including Amazon and Flipkart are not allowed to directly sell products in the country. Following the Tesla dispute in India, now Acko, the Indian insurer has requested the Indian government's involvement in a potential trademark infringement case in China. Discussing this with LiveMint, our partner Siddharth Mahajan said that “such cases, the government usually does not intervene as it has no major role to play”. He further said “trademark protection is territorial, and trademark owners are expected to protect their trademarks in countries of interest. Tesla Inc's first lawsuit in India targets Tesla Power India Pvt Ltd for trademark infringement, alleging misleading use of the Tesla name in association with EV batteries. This case has highlighted the importance of trademark protection in India's growing EV market. Discussing this incident with LiveMint, our partner Siddharth Mahajan, said “Since the Whirlpool case, Indian courts have recognised the concept of transborder reputation of trademarks and protected the rights of trademark owners in numerous cases. Courts have recognised the fact that a mark may not have been used in India by its foreign owner but the rights vesting in the trademark can be protected in India if people are aware of the brand or trademark here.” He also noted that the Supreme Court diluted its position in a case involving Toyota’s Prius brand of hybrid cards in 2017. The defendant, Prius Auto Industries Ltd, began manufacturing spare parts and accessories for cars in India in 2001 and registered the trademark ‘Prius’ in 2002. The court held that advertisements in various magazines and information available online was not adequate to establish the reputation and the goodwill of Toyota’s mark in India.
