AIPPI World Congress 2024: PATENT TERM EXTENSIONS Remfry & Sagar Partner Shukadev Khuraijam was at the 2024 AIPPI World Congress in Hangzhou, China, where he was part of a panel that discussed the impact and relevance of #patent #term #extensions (PTE) in different jurisdictions. The session was titled: 'It's Not Yet My Time: Patent Term Extensions' and involved lively discussions between the panelists - Shukadev as well as Ivy Tsui (Gilead), Lilian Roriz (Licks Attorneys), Hongqiang Liu (Bayer) and Michael Alt (TQJ at the Unified Patent Court). The audience posed quite a few questions and Shukadev explained India’s peculiar position as a developing economy - one which provides over 20% of the world’s supply of generic drugs - and the nuanced balance the Indian government must maintain. He also discussed the proposed FTA agreement between the UK and the Indian government which includes the issue of PTE and hinted that there is more to it than meets the eye! #remfry #patents #AIPPI #AIPPIWorldCongress

Gilead Sciences, a U.S. based #pharmaceutical company, recently signed non-exclusive, royalty-free voluntary #licensing agreements with six #generic manufacturers to produce and sell generic versions of the #HIV prevention drug #Lenacapavir in 120 low- and middle-income countries. Among these countries is India which has the biggest generic drug industry outside the U.S. Prior to Gilead’s signing of the licensing agreements, #pregrant oppositions to its patent applications in India for Lenacapavir were filed mainly by community health organizations and patient groups. PATENTS - Section. 3(d) In a case argued by Remfry & Sagar, Nippon Steel v The Controller General of Patents, Designs and Trademarks (2024:DHC:6514), the Delhi High Court has adjudicated on core issues concerning #patent #eligibility assessments of #inventions under Section 3(d) of the Patents Act 1970. Ultimately, the court set aside the Patent Office's refusal order for: - violating the principles of #naturaljustice; - lacking technical analysis of the claimed method; - not applying any test or standard for patent eligibility of the subject matter; - for not identifying the known device due to which Section 3(d) was raised and remanded the matter back for fresh consideration. Interestingly, the court has also directed the IPO to delve deeper into other patentability nuances of the invention. Could CLARI-FI Cancel CLARIWASH? L’Oréal requested the cancellation of cosmetic company Innovative Derma Care’s registered #trademark CLARIWASH after the Registrar of Trademarks made an error in the mark’s examination report - search for prior records was conducted re CHARIWASH instead of CLARIWASH and, thus, failed to throw up L'Oreal prior mark CLARI-FI. According to the court, CLARIWASH was not deceptively similar to CLARI-FI, and the former was not liable to be cancelled because the Registrar’s procedural error was not grounds for refusal under trademark law. The CLARIWASH mark was subsequently advertised in the Trademarks Journal, in which it was spelled correctly and though L’Oréal could have reasonably opposed it at that stage, it had failed to do so. Accordingly, no case for #cancellation was made out.
