Reforming the appointment (and removal) process of key public officers in Malaysia (comprised of the heads of professional, adjudicating and regulatory institutions in this nation) is vital for the protection of multiparty democracy and the rule of law. Today, in Parliament, Prime Minister Anwar Ibrahim sums up his position on political appointees in GLCs: "We do not discriminate between politicians and non-politicians". Which is just another way of saying, as things stand, political appointments to GLCs will continue in Malaysia. Todate, it is estimated that the current administration had roped in 95 political appointees in GLCs. Recently, convicted former Prime Minister Najib Razak's daughter, Nooryana Najwa, was appointed to the board of MATRADE, which drew heavy criticism. The underlying problem: (1) concentration of appointing power in the hands of the Executive, notably the Prime Minister; (2) no transparency in the process of appointment of these GLC leaders. This, whether directly or indirectly, creates an unfortunate system of patronage, cronyism & corruption. In 2021, BERSIH & I worked on a report to reform the appointments of key public officers in Malaysia. It studies the US, UK & Canadian experience in this area, and then recommends the enactment of a Public Appointments and Removal Bill 2021 - which would allow civil society & the Legislature to have greater say & scrutiny over the appointment (and removal) of key public officers. I don't think anyone sees this as a priority for reform at the moment. But hopefully, when the time comes, we will see a more robust, inclusive & democratic appointment process of GLC heads.
