The discussions highlighted opportunities for Kosovo to integrate solar into its energy mix while addressing key market and regulatory challenges, and the significance of initiatives like WEM in promoting diversification within the renewable energy sector.⚡☀️

Honored to have spoken at CISOLAR - Solar & Energy Storage Expo & Conference of CEE last week on some key legal challenges for #RenewableEnergy projects in România. We addressed key issues including: 𝐏𝐔𝐙 𝐟𝐨𝐫 𝐓𝐲𝐩𝐞 𝐁 𝐏𝐫𝐨𝐣𝐞𝐜𝐭𝐬: According to the applicable legislation, RES investors still require PUZ for projects greater thatn 50 ha. However, the Ministry of Agriculture does not issue the indorsement on soil quality required for the PUZ approval. Thus, the investor are obliged to split the projects. This triggers complications and potential breach of environmental rules. 𝐀𝐫𝐞 𝐬𝐭𝐚𝐧𝐝𝐚𝐥𝐨𝐧𝐞 𝐁𝐄𝐒𝐒 𝐩𝐫𝐨𝐣𝐞𝐜𝐭𝐬 𝐞𝐱𝐞𝐦𝐩𝐭 𝐟𝐫𝐨𝐦 𝐭𝐡𝐞 𝐏𝐔𝐙 𝐫𝐞𝐪𝐮𝐢𝐫𝐞𝐦𝐞𝐧𝐭? Differing interpretations of construction and urban planning law. While the law exempts energy production and storage projects from requiring a PUZ, some chief architects still demand a PUZ for standalone storage projects. They argue that the exemption only applies to co-located energy production and storage projects, causing delays and increased costs for standalone storage developments. 𝟓% 𝐛𝐨𝐧𝐝 𝐟𝐨𝐫 𝐀𝐓𝐑: The recently amended Grid Connection Regulation mandates that financial guarantee must be established and paid before the issuance of the ATR. However, the regulation does not specify a maximum deadline for establishing the financial guarantee or any penalties, such as the invalidation of the solution study. 𝐒𝐚𝐧𝐜𝐭𝐢𝐨𝐧 𝐨𝐟 𝐀𝐛𝐬𝐨𝐥𝐮𝐭𝐞 𝐍𝐮𝐥𝐥𝐢𝐭𝐲 𝐢𝐧 𝐔𝐧𝐚𝐮𝐭𝐡𝐨𝐫𝐢𝐳𝐞𝐝 𝐈𝐧𝐯𝐞𝐬𝐭𝐦𝐞𝐧𝐭𝐬: Agreements or clauses involving direct foreign, EU, or new investments without proper authorization are subject to absolute nullity. Astăzi, în calitate de membru al directoratului Societății de Administrare a Participațiilor în Energie S.A. – SAPE, am participat ca speaker la CISOLAR & GREENBATTERY 2024, un eveniment important pentru viitorul energiei regenerabile în România. Începând cu 2021, activitatea SAPE s-a diversificat, concentrându-se pe lângă activitatea de administrare a participațiilor și pe producția de energie din surse regenerabile. Deținem în prezent 27 MW instalați în capacități eoliene și solare, având ca obiectiv atingerea unui total de 100-150 MW până în 2026. Diversificarea mixului de producție este un element esențial al strategiei noastre. De asemenea, am demarat proiectul pentru termocentrala Titan, care va funcționa pe gaze în cogenerare de înaltă eficiență. Deși am solicitat finanțare prin Fondul pentru Modernizare, continuăm discuțiile cu băncile pentru a asigura resursele necesare. Acest proiect va contribui la stabilitatea sistemului energetic național și la reducerea emisiilor. Stocarea energiei reprezintă o prioritate pentru noi. Am finalizat un proiect de stocare a energiei în baterii la Dârvari și intenționăm să continuăm investițiile în capacități de stocare. Aceste inițiative ne vor ajuta să asigurăm flexibilitate și eficiență în sistemul energetic. Proiectul SAPE pentru Hidrogen Verde: O Inovație în Stocarea Energiei SAPE a obținut finanțare din Planul Național de Redresare și Reziliență pentru proiectul „Unitatea de producție hidrogen verde prin electroliză – Hidrogen HY S.A.P.E. 10”, în valoare de 54.632.988,24 lei, din care 29.959.755,00 lei (aproximativ 54,8%) reprezintă finanțare PNRR. Această instalație va produce anual 425 tone de hidrogen verde, utilizând 3 MW de energie regenerabilă, contribuind astfel la tranziția energetică și decarbonizarea Uniunii Europene. Despre SAPE Societatea de Administrare a Participațiilor în Energie S.A. (SAPE) a fost înființată în 2013 prin divizarea parțială a SC Electrica S.A., preluând toate drepturile și obligațiile din contractele de privatizare ale fostelor companii Electrica Banat, Electrica Dobrogea, Electrica Moldova, Electrica Oltenia și Electrica Muntenia Sud. Cele mai importante participații ale SAPE includ Titan Power (67,3%), Indra Soluciones Tecnologias de la Información România (49%), PPC Energie (37%), Rețele Electrice Dobrogea (24,9%), Rețele Electrice Banat (24,87%), Fondul de Investiții în Energie Kazah-Român (20%), PPC Energie Muntenia (10%) și Rețele Electrice Muntenia (10%). SAPE S.A. are un capital social de 868,5 milioane de lei, împărțit pe acțiuni nominative, cu o valoare nominală de 10 lei fiecare.
