On September 14th, as part of the China IP Annual Conference, the Eurasia IP, an international conference on IP and technology, was held. The event was organized by the Eurasian Patent Office (EAPO). This year's conference is dedicated to cooperation with China, one of the key partners of the EAPO member states, which holds a leading position in their foreign trade and investment partnership. EAPO President Grigory Ivliev said that patenting in Eurasia will become more relevant for Chinese companies. The Trademark Lawyer Magazine published an article by Olga Plyasunova, Head of the Trademark Department, on the assessment of the widespread popularity of a trademark in Russia. The article shows what advantages the trademark status provides to the rightsholder and how its wide popularity is assessed to provide legal protection in Russia. On September 9, the Eurasian Patent Office celebrated the anniversary of the Eurasian Patent Convention. In honor of the 30th anniversary, a special event was held, attended by the leaders of national patent offices from member states of the Eurasian Patent Organization as well as Deputy Secretary General of the Commonwealth of Independent States, Ilkhom Nematov, and Deputy Minister of Foreign Affairs of the Russian Federation, Alexander Pankin. Sergey Zuykov, managing partner and Eurasian patent attorney, gave a speech at the ceremony. During the event, the EAPO and the Belarus, Russia, and Tajikistan departments signed a Memorandum of Understanding on the Eurasian Accelerated Patent Office Program. LEBER LLC appealed to the Arbitration Court of the Bryansk region with a claim for recovery in solidarity with YUAMET LLC and individual entrepreneur Krasnikov A.A. for the protection of the exclusive right to industrial design No. 135579. In this case, Zuykov and partners represented the plaintiff's interests, LEBER LLC. Patent No. 135579 protects two versions of the game complex in different colors. The patent holder became aware that through the website yuamet.com the activity is carried out on the offer for sale of the product DG.EP023 Children's play complex "Eco-play", according to the expert opinion submitted by the plaintiff dated 05/16/2023, both versions of the game complex protected by a patent are used. Objecting to the plaintiff's claims, the defendants referred to the fact that their actions did not violate the exclusive right to a patent, pointing out that all the essential features of an industrial design were not used in the disputed product, since playgrounds significantly differ in configuration, color combination, and the relative position of elements. To establish the fact that the defendants used an industrial design under patent No. 135579, the court appointed a judicial examination. According to its results, the expert concluded that the product DG.EP023 Children's play complex "Eco-play" contains all the essential features of the industrial design "GAME COMPLEX" under patent No. 135579. In this case, it was important for the plaintiff to establish by the court the fact of a violation on the part of the defendants to prevent both the current violation and the prevention of future ones. #industrialdesign #ip #russia https://lnkd.in/dTqgz2z7

The IP Court considered Pfizer Products Inc.'s application for invalidation of Rospatent's decision dated 05/26/2023, based on the results of consideration of an objection to the validity of the Eurasian patent for invention No. 012666 in the territory of the Russian Federation. The Eurasian Patent Office and PSK PHARMA LLC were involved in the case as third parties who do not make independent claims regarding the subject of the dispute. Zuykov and partners represented the interests of PSK Pharma. In this case, we are talking about Eurasian patent EA No. 012666 for a group of inventions with a filing date of 05/29/2002. On 06/21/2022, Rospatent received an objection from PSK Pharma against the validity of this patent on the territory of the Russian Federation, motivated by the inconsistency of the patented group of inventions with the conditions of patentability "industrial applicability", "novelty" and "inventive step", as well as the presence in the claims of features that were absent in the application materials on the date of its filing. The arguments of the objection relate to independent paragraphs 16 and 17, in respect of which the validity period of EA patent No. 012666 in Russia was extended until 05/29/2027. As a result, Rospatent satisfied the objection and recognized the validity of the Eurasian patent for invention No. 012666 in the territory of the Russian Federation as completely invalid. Pfizer disagreed with Rospatent's conclusions. However, the court, having assessed the evidence presented, considered that the applicant's claim to invalidate the contested decision of Rospatent could not be satisfied. At the beginning of 2024, there were about 3,445 franchises in Russia. At the same time, Russian legislation does not contain the concept of a "franchise agreement". Chapter 54 of the Civil Code of the Russian Federation contains the concept of a commercial concession agreement; Article 1028 of the Civil Code provides for a written form of the agreement, as well as mandatory state registration of the granting of the right to use a set of exclusive rights in Rospatent. The procedure for termination of such contracts is of fundamental importance, as in any contract. In practice, quite often there are situations where after the termination of a commercial concession agreement, the user continues his activities with minor changes to the set of rights provided under the agreement, considering that in this case the rights of the copyright holder cannot be violated, since the agreement is considered terminated.
