Recently, our IP Partner, Esther Wee, spoke at the EdTech Asia 2024 Singapore. Esther joined a panel of experts for a lively discussion on "Navigating the legal landscape of AI & #Education: #Data #Privacy, Policy, Protection, and IP".  The interactive session covered: •⁠ ⁠Current trends and challenges in AI •⁠ ⁠Ethical issues arising out of the gen AI trends •⁠ ⁠Components of #IP ownership Esther also shared her points on IP ownership and what to look out for in a software agreement involving #AI solutions and the position companies should adopt from a commercial standpoint where the laws are still evolving in this space. Attendees gained valuable insights and took away practical knowledge from the session.

I was happy to contribute towards the Protection of Children's Personal Data ("PD") at the Cybersecurity and Data Protection Day by The Law Society of Singapore. Thanks to our moderator Lorenda LEE 李婷, and fellow panelists Timothy M. Francis Zhang and Darren Grayson Chng for their thoughtful insights. Thanks also to Jansen Aw, Jeremy Lua and Joey Pang for organising this, and not to mention the team from the Law Society of Singapore. My personal concerns and salient issues:- + Consensus Incapax - that it would be practically difficult to discern if a child between 13 and 17 would really understand the consequences of providing consent to using his/her PD online; + that the giving of consent, even by a parent, to using the child's PD on Social Media, does not remove the Protection obligation to prevent the unwanted collection of PD by unknown sources; + whether there is a case the the proper notification of purpose for the collection of consent, should in the case of Children's PD include the consequences of consenting to such use; + that there has to be a balance between proper sharing of children's images online for publicity and related purposes against unnecessary oversharing and should there be prescriptive safeguards in place; + whether we could learn best practices from other countries or specific industries - my favourite is the act of pixelating the faces of young children; Of the concerns raised, regulation alone may not provide the answer, and technology, together with a more defensive mindset in conjunction with robust regulatory regime, might have to be the way forward. #childrenspersonaldata #protectionofchildren #singaporepersonaldataprotection #personaldataprotectionlaw RHTLaw Asia LLP #singaporelaw #consensusincapax
