We’re pleased to announce a successful settlement of £10,411* for our client, 'Elizabeth', in her motor vehicle finance affordability case. In 2018, Elizabeth financed a Vauxhall GTC Coup valued at £12,495, but due to a high interest rate of 31.3%, the total repayable nearly doubled. Despite her existing financial struggle, including a County Court Judgment and other loan and credit card debt, these were not raised during her credit check by the financial provider. During the agreement, her car was stolen, which led to higher repayments. Later, the pandemic forced her business to close, and her request for a payment holiday was denied, worsening her financial situation. When Elizabeth approached us, we identified her agreement as unsuitable and submitted an affordability complaint on her behalf, securing the compensation she deserved. From today, UK banks and payment providers must refund customers who have fallen victim to APP fraud, following new rules introduced by the Payment Systems Regulator (PSR). These rules aim to provide better protection and faster dress for victims of fraud. However, there is a refund limit of £85,000 meaning those who have lost more may not be able to reclaim their total loss back. Some banks and payment providers have also introduced a £100 excess fee for the processing of refunds. While the intention behind the fee is to encourage better vigilance among bank customers, it has sparked criticism that victims are being penalised for falling prey to increasingly-sophisticated scams. We are pleased to have secured a successful settlement of £22,145* for our client George in his motor vehicle finance affordability case! In 2015, George purchased a Range Rover Sport via a Hire Purchase (HP) agreement, but with a staggering APR rate, including interest, of 25.9%, he ended up paying over £40,000 for a £26,598 car. His £700+ monthly repayments left him struggling with mental health as his income was drained by the loan. We are proud to share that Barings Law and our Head of Data Breach, Adnan Malik, have been featured in Infosecurity Magazine . Their recent article highlights our ongoing legal action on behalf of almost 8,000 claimants who were affected by the Capita data breach last year. The breach, which impacted dozens of pension schemes, has seen personal information such as bank details, addresses and national insurance numbers exposed.
